This ordinance is summarized as follows: The City of Paducah accepts the on-line bid of Paducah Woodenware for leaf bags in the amount of $55,475.99 for use in the City of Paducah's Yard Waste Collection Program and authorizes the Mayor to execute a contract for same. PAXTON PARK FUNDING Commissioner Guess offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A CONTRACT WITH PAXTON PARK GOLF BOARD FOR SPECIFIC SERVICES AND AUTHORIZE THE FINANCE DIRECTOR TO TRANSFER FUNDS- TO SAID BOARD." This ordinance is summarized as follows: The City of Paducah authorizes and directs the Mayor to execute a contract with Paxton Park Golf Board in the amount of $35,000 for specific services for the Paducah area and authorize the Finance Director to transfer said funds from Commission Contingency. NOBLE PARK TENNIS COURT RESURFACING Commissioner Montgomery offered motion, seconded by Commissioner Smith, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE ACCEPTING THE BID OF TENNI-TRAC SPORTS SURFACES FOR THE RESURFACING OF THE NOBLE PARK TENNIS COURTS AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME." This ordinance is summarized as follows: That the City of Paducah accepts the bid of Tenni-Trac Sports Surfaces in the amount of $22,000, for the resurfacing of the Noble Park tennis courts and authorize the Mayor to execute a contract for same. AMEND NOISE ORDINANCE Commissioner Smith offered motion, seconded by Commissioner Montgomery, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING ARTICLE IV. NOISE OF THE CODE OF ORDINANCES OF THE CITY 445 SEPTEMBER 14, 2004 OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: The City of Paducah has amended its ordinance regulating uncontrolled noise within the City of Paducah. The ordinance maintains the restriction on prohibited noises and sound levels., although some levels were lowered for evening hours. The ordinance removed the time restrictions regarding enforcement. The ordinance also establishes "Quiet Zones," which are areas to be determined by the Traffic Commission. Any area designated a "Quiet Zone" will have a sign posted to alert those passing by. The ordinance eliminates the hardship permit and establishes a special variance procedure, which allows a person to seek a variance from the noise prohibitions and noise level restrictions by filing an application with the City Manager thirty (30) days prior to the date on which the special variance is to be effective. As required by KRS 83A.060, the following Section 2 of the Ordinance is set forth in its entirety: The provisions of this article shall be enforced in the same manner as other violations of the city Code of Ordinances. Any person violating any of the provisions of this article shall be deemed guilty of a Class B misdemeanor, and upon conviction thereof, shall receive a fine not to exceed $250.00 or a jail sentence not to exceed ninety (90) days, for each offense. Each day that such violation continues shall constitute a separate offense. This article and the foregoing penalties shall not be construed to limit or deny the right of the city or any person to such equitable legal remedies as may be available by law. AMEND ORDINANCE FOR VEHICLES DRAWN BY ANIMALS Commissioner Coleman offered motion, seconded by Commissioner Guess, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING CHAPTER 122, VEHICLES FOR HIRE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY." This ordinance is summarized as follows: The City of Paducah hereby amends Chapter 122 to require routes of animal -drawn vehicles be approved by the Traffic Commission; that each carriage is to have a separate and unique identification number displayed on the rear of the vehicle, and to require that each operator obtain either a Downtown Horse Carriage Tour Permit or a Contract Operating Permit. The procedure for bidding on such permits as well as standards and requirements for carriage companies who win such bids is established.
