HomeMy WebLinkAbout09/07/04438 SEPTEMBER.7, 2004 At a Regular Meeting of the Board of Commissioners, held on Tuesday, September 7, 2004, at 5:00 p.m., Mayor Paxton presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Coleman, Guess, Montgomery, Smith and Mayor Paxton (5). ORDINANCE — INTRODUCTION DOWNTOWN MARKETING STUDY CONTRACT APPROVAL Commissioner Coleman offered motion, seconded by Commissioner Guess, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A LETTER OF PROPOSAL DATED AUGUST 23, 2004 TO CONDUCT A MARKET ANALYSIS FOR THE CITY'S DOWNTOWN AND WATERFRONT AREA." This ordinance is summarized as follows: That the City of Paducah hereby authorizes and directs the Mayor to execute an agreement with Economics Research Associates in the amount of $37,750.00 to conduct a market analysis for the City's downtown and riverfront area. EMERGENCY REPAIR OF A 30" PIPE AT FLOOD CONTROL PUMP PLANT #2 Commissioner Guess offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO PAY FOR THE EMERGENCY REPAIR OF A 30" PIPE LOCATED AT FLOOD CONTROL PUMP PLANT #2 AND TRANSFER FUNDS FOR SAID REPAIR." This ordinance is summarized as follows: That the City of Paducah hereby authorizes the Finance Director to make payment in the amount of $17,960.00 to Murtco Mechanical Contractors Inc., for emergency repairs of a 30" pipe located at Flood Control Pump Plant #2 and authorizes the transfer of said funds. AMEND ABOVE ORDINANCE Commissioner Smith offered motion, seconded by Commissioner Montgomery, that the above ordinance entitled, "AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO PAY FOR THE EMERGENCY REPAIR OF A 30" PIPE LOCATED AT FLOOD CONTROL PUMP PLANT #2 AND TRANSFER FUNDS FOR SAID REPAIR," be changed from an introduction to an emergency reading due to approaching inclement weather and be adopted. Adopted on call of the roll, yeas, Commissioners Coleman, Guess, Montgomery, Smith and Mayor Paxton (5). ORD. NO. 2004-9-6861; BK 30; PG SINGLE SOURCE REPAIR OF A PUMP AT FLOOD CONTROL PUMP PLANT #2 Commissioner Montgomery offered motion, seconded by Commissioner Smith, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO PAY FOR THE SOLE SOURCE REPAIR WORK OF A PUMP LOCATED AT FLOOD CONTROL PUMP PLANT #2 AND TO TRANSFER FUNDS FOR SAID REPAIR." This ordinance is summarized as follows: The Finance Director is hereby authorized to pay to Industrial Maintenance & Electrical Corporation the amount of $11,200.00 for the repair of a 500 hp pump located at Flood Control Pump Plant #2 and to transfer funds for said repair from the Four Rivers Center Account to the Engineering Department/Floodwall Account. NO. 2004-9-6862; BK 30; PG 439 SEPTEMBER 7, 2004 WORKSHOP POLICING PLANS: 7TH & ADAMS AREA Police Chief Bratton reported that two patrol officers would be assigned to this area for extra enforcement. FIRE DEPARTMENT ACCREDITATION PLAN The Fire Chief reported that Asst. Chief Mark Cunningham has volunteered to be the key person to handle the accreditation process. The process will take about 2 years. The Commission wants the Chief to make periodic updates regarding the process. PAXTON PARK BRIEFING The Paxton Park Golf Board gave a Capital Improvements Wish List Status Report. They are trying to make the golf park more marketable. They requested $35,000 for operations. These funds will help operate the park through March of 2005. So far all improvements have been made without using any tax dollars. PROPERTY TAX LEVY Jon Perkins, Finance Director, gave an overview of the tax levy and how to calculate it. He gave a history for the tax levy from FYI 995 to the present. The tax rate has not increased since FY1999 and there will not be an increase this year. (Handouts are in the minute file.) COMMISSION PRIORITIES/CITY MANAGER GOALS The City Manager discussed his goals for FY2005 and asked for any comments or suggestions from the Commission. A copy is in the minute file. CITY MANAGER REPORT • ADULT ENTERTAINMENT ORDINANCE The City Manager mentioned the memorandum sent out in the packets regarding the Adult Entertainment Ordinance. The McCracken County Fiscal Court is going to appeal a ruling from the State Court that invalidates the County ordinance. The County ordinance is based on the City's Ordinance; so the court decision will effect the city ordinance. He recommends the City join with the County and split the cost of the legal services. Payment will be made from the appropriate legal services account unless there is objection from the Board. Preliminary estimate of legal services is at $8,000. No objection from the Board. • Request Ex. Session for economic development Mayor informed the Board that there would be a request coming to the Planning Commission for a zone change for 1210-1224 Bernheim Avenue. EXECUTIVE SESSION Commissioner Smith offered motion, seconded by Commissioner Guess, that the Board go into closed session for discussion of matters pertaining to the following topics: • A specific proposal by a business entity where public discussion of the subject matter would jeopardize the location, retention, expansion or upgrading of a business entity, as permitted by KRS 61.810(1)(g).
