HomeMy WebLinkAbout86-10-2929673 ORDINANCE NO. 86-10-22944 AN ORDINANCE AMENDING SECTIONS 27-12 and 27-69.5, "REFUSE", OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY WHEREAS, Section 27-69.5 of the Code of Ordinances of the City of Paducah restricts private haulers from collecting, transporting, or disposal on a commercial, contract or agreement basis, of refuse from commercial accounts to areas of the city annexed by the city after 1975; and WHEREAS, Section 27-69.5(2) provides that the City of Paducah will review "all new accounts under this subsection" "as of July first of each year and a determination made whether or not the city can provide the required services"; and WHEREAS, the Board of Commissioners of the City of .Paducah has determined that the city is capable of collecting all refuse within the City of Paducah, and at the best interest of the citizens of the city would be served by the city being the sole provider of refuse collections within the City of Paducah, including roll -off container service; and WHEREAS, it is also the intent of the Board of Commissioners not to deprive private collectors of business accounts which they presently serve. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 27-12 is hereby amended to read as follows: "Private collectors authorized to collect refuse in the City of Paducah, Kentucky, and private commercial collectors operating within the limits of McCracken County, Kentucky, shall be licensed upon their application to the City Treasurer to dispose of collected waste and refuse at the City's sanitary landfill upon the purchase of a dumping license as follows: (a) For vehicles capable of carrying eight (8) cubic yards or less, there shall be a dumping fee of $;-69 15.00 per entry into the landfill for the purpose of dumping refuse; (b) For vehicles with a load capacity from eight (8) yards up to and including sixteen (16) yards, a dumping fee of $�5-29 30.00 per entry into the landfill for the purpose of dumping refuse; (c) For vehicles with a capacity from sixteen (16) up to and including twenty (20) cubic yards, a dumping fee of 40.00 per entry into the landfill for the purpose of dumping refuse; (d) For vehicles with a capacity from twenty (20) yards up to and including thirty (30) yards, a fee of $a8759 60.00 per entry line into the landfill for the purpose of dumping refuse; (e) For vehicles with a capacity from thirty (30) yards up to and including forty (40) yards, a fee of $38-99 80.00 per entry into the landfill for the purpose of dumping refuse; (f) For all vehicles with a capacity in excess of forty (40) cubic yards, the dumping fee shall be negotiated with the City Manager. (g) The foregoing license fees shall be paid to the City Treasurer who shall issue coupon booklets to the licensee based on size of vehicle. Individual coupons shall be collected by city employees at the landfill and returned periodically to the City Treasurer for verification of records." SECTION 2. That Section 27-69.5(1) is hereby amended to read as follows: "(1) Roll -off container service. A "roll -off container service" is defined as a service which picks up the container at the premises of the customer and takes the 674 entire container to the landfill and returns the emptied container to the customer's place of business. Permits for this type of service will be issued to any qualified applicant for any location within the city limits. No.new accounts may be acquired after November 1, 1986, and a permit will not be issued for any accounts not serviced on that date. Each permittee shall submit to the City Manager a complete list of all accounts serviced within the city limits on or before December 31, 1986." SECTION 3. This ordinance shall be read on two separate days and will become effective upon publication of title and a certified summary thereof.
