ORDINANCE NO. 86-10-2-9- $
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN ENCROACHMENT AGREEMENT WITH
WAGNER ENTERPRISES, LOCATED AT 1719 NORTH 8TH STREET AND 1800 NORTH 10TH STREET
WHEREAS, Wagner Moving & Storage, Inc. is the owner of certain real property located
at 1719 North 8th Street and 1800 North 10th Street; and
WHEREAS, these locations do not provide sufficient space for improvements to these
buildings; and
WHEREAS, Wagner Enterprises has requested from the City of Paducah permission to make
improvements to the above-described buildings.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor be, and he is hereby, authorized to enter into an
Encroachment Agreement with Wagner Enterprises for:
1. The eastern most end of Palm Street and abutting Wagner Enterprises.
2. The alley between Olive Street and Cole Street and abutting Wagner
Enterprises.
SECTION 2. These encroachments are for the following construction:
(a) Certain electrical feeder cables below ground (approximately 7" below
grade) between 1800 North 10th Street and 1719 North 8th Street.
(b) Certain light fixtures (approximately 20 feet above grade) located on
the outside of Wagner Enterprises Warehouses.
(c) A canopy projection over the most eastern end of Palm Street
(approximately 5'), elevation 16' above grade.
(d) Certain drainage pipes below grade (approximately 4' below grade).
SECTION 3. Said Encroachment Agreement is attached hereto and made a part hereof, as
if fully set out herein.
SECTION 4. The Mayor and Corporation Counsel are to approve the content and form of
this Encroachment Agreement.
SECTION 5. All plans that would affect the City right-of-way are to be approved by
the City Engineer's Office.
SECTION 6. This ordinance shall be read on two separate days and will become
effective upon publication of title and a certified summary thereof.
