HomeMy WebLinkAbout86-8-2906ORDINANCE NO. 86-8-2906 AN ORDINANCE APPROVING THE CLOSING OF A PORTION OF IROQUOIS DRIVE LOCATED BETWEEN ROCK CREEK CIRCLE AND SENECA LANE_.. WHEREAS, G.W. Crisp, et:al4 have requested "that,a portion of the right-of-way known as Iroquois Drive be closed;; and WHEREAS, the Planning Commission passed this request to the Board of Commissioners without any recommendation; and WHEREAS, the Board of Commissioners finds that this right-of-way is unimproved and is not needed as a public right-of-way. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The City of Paducah does hereby authorize the closing of a portion of Iroquois Drive between Rock Creek Circle and Seneca Lane, which is more particularly described as follows: Beginning at a concrete monument located in the right-of-way line of Cherokee Heights Subdivision and Fox Harbor Subdivision and also being located in the south right-of-way line of Iroquois Drive; thence in an easterly direction and along the south right-of-way line of Iroquois Drive 150 feet to a;co,ncrete monument; thence in a northerly direction 60 feet to a concrete monument located in the north right-of-way line of Iroquois Drive; thence in a westerly direction 150 feet to a concrete monument located in the right-of-way line of Cherokee and Fox Harbor Subdivisions; thence in a southerly direction 5 feet to a concrete monument; thence in a westerly direction along the north right-of-way line of Iroquois Drive 80 feet to a concrete monument; thence along the arc of a curve 31.42 feet the interior angle to the chord being 225 degrees; the chord distance being 28.28 feet to a concrete monument; thence in a southerly direction 90 feet to a concrete monument; thence along the arc of a curve 31.42 feet, the interior angle to the chord being 45 degrees, the chord distance being 28.28 feet to a concrete monument; thence in an easterly direction 80 feet to a concrete monument located in the right-of-way line of Cherokee and Fox Harbor Subdivisions; thence in a southerly direction 5 feet to the point of beginning. SECTION 2; The City of Paducah is approving the closing of the right-of-way contingent upon the adjoining property owners granting to the City a permanent utility easement on, over and under the right-of-way being closed. SECTION 3. The Corporation.Counsel of the City of Paducah, Kentucky, be, and he is hereby, authorized, empowered and" directed to institute and prosecute, pursuant to KRS 82.405, an action in McCracken Circuit Court for a judgment ordering the closing of the street described in Section 1 above. SECTION 4. This ordinance shall be read on two separate days and will be effective upon publication of title and a certified summary thereof.
