ORDINANCE NO. 86-8-2902
AN ORDINANCE APPROVING THE CLOSING OF A PORTION OF FLOURNOY STREET LOCATED BETWEEN
NORTH TENTH STREET AND ILLINOIS CENTRAL RAILROAD
WHEREAS, Purchase Packers, Inc. has requested that a portion of the right-of-way
known as Flournoy Street be closed; and
WHEREAS, the Planning Commission approved this closing on July 21, 1986; and
WHEREAS, the Board of Commissioners finds that this right-of-way is unimproved and
is not needed as a public right-of-way.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The City of Paducah does hereby authorize the closing of a portion of
Flournoy Street between South Tenth Street and the Illinois Central Railroad, which is more
particularly described as follows:
Beginning at an iron pin located in the junction of the right-of-way
lines of Flournoy Street and North 10th Street; thence in a westerly
direction and along the north right-of-way line of North 10th Street,
60.14 feet to an iron pin located in the west right-of-way line of
Flournoy Street; thence in a northerly direction along the west right-
of-way line of Flournoy Street, 380 feet to an iron pin located in the
south right-of-way line of the Illinois Central Railroad; thence in an
easterly direction along the south right-of-way line of the Railroad,
60.14 feet to an iron pin located in the east right-of-way line of
Flournoy Street; thence in a southerly direction along the east right-
of-way line of Flournoy Street, 380 feet to the point of beginning.
SECTION 2. The City of Paducah is approving the closing of the right-of-way
contingent upon the adjoining property owners granting to the City a permanent utility
easement on, over and under the right-of-way being closed.
SECTION 3. The Corporation Counsel of the City of Paducah, Kentucky, be, and he is
hereby, authorized, empowered and directed to institute and prosecute, pursuant to KRS
82.405, an action in McCracken Circuit Court for a judgment ordering the closing of the
street described in Section 1 above.
SECTION 4. This ordinance shall be read on two separate days and will be effective
upon publication of title and a certified summary thereof.
