HomeMy WebLinkAbout86-7-2893634 ORDINANCE NO 86-7-2893 AN ORDINANCE CREATING A CITY -COUNTY EMERGENCY COMMUNICATIONS SERVICE BOARD WHEREAS, the City of Paducah has adopted an ordinance indicating the intent of the City of Paducah to establish a City -County Emergency Communications Service Board; and WHEREAS, McCracken County, Kentucky, has adopted a similar ordinance expressing the intent of the County Commissioners to establish a City -County Emergency Communications service; and WHEREAS, KRS 65.750 allows the City of Paducah and McCracken County to enter into a cooperative program for the establishment of an Enhanced 911 Commitnications__Service; and WHEREAS, it is the intent of Board of Commissioners of the City of Paducah to create a joint board with McCracken County to oversee the operation of the Emergency Communications Service. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. There is hereby created a joint City -County Board to be styled "Paducah - McCracken County Emergency Communications Service Board", which shall be made up of six (6) members, three of which shall be appointed by the Mayor of the City of Paducah, subject to the approval of the Board of Commissioners, and three of which shall be appointed by the McCracken County Judge/Executive, subject to the approval of the Fiscal Court of McCracken County. SECTION 2. Initially the Board shall be appointed so that two members shall serve for a term of one year, two members for a term of two years, and two members for a term of three years; such terms are to expire, in each instance, upon June 30, and thereafter until a successor is appointed and accepts appointment. Upon expiration of these initial, staggered terms, successors shall be appointed as above set forth for terms of three years, and until their successors are appointed and accept their appointments. Members of the Board shall be eligible for reappointment. SECTION 3. The members of the Board shall be allowed reasonable expenses necessarily incurred by them in the conduct of the affairs of the Board. Otherwise, the members of the Board shall serve without compensation. SECTION 4. The Board shall operate on a fiscal period, starting July 1 of each year and ending the next ensuing June 30. SECTION 5. A majority of the members of the Board shall constitute a quorum for the transaction of business. An affirmative vote of a majority of a quorum shall be necessary for the adoption of any motion, measure or resolution. The Board shall be responsible for overall planning of emergency telephone systems in Paducah and McCracken County. The ultimate goal of such planning shall be the implementation and operation of an Enhanced 911 Emergency Communi- cations Service, supplying telephone and dispatch services for all emergency facilities in Paducah and McCracken County. SECTION 6. The Board shall establish a budget for each ensuing fiscal year for the operation of the Emergency Communications Service and allocate the cost of operating the Emergency Communications Service among the various governmental units participating in the services of the Board. The Board's budget shall be prepared and submitted to the various governmental officials before April 1 of each year. Submission of a budget by the Board to the a► governmental agencies does not commit the agency to fund the Emergency Communications Service until said budget is approved by the governmental agencies. The cost of the operation of the Emergency Communications Service shall be apportioned among the City of Paducah and McCracken County according to the benefits received by each governmental agency. SECTION 7. The Board shall approve all monies that are to be expended on the Emergency Communications Service. SECTION 8. The Board shall keep records on any equipment donated by the City of Paducah or McCracken County, or any other governmental agency, to the Emergency Communica- tions Service, and said equipment shall remain the individual property of the governmental agency donating the use of the equipment. When the equipment is no longer needed by the Board for the operation of the Emergency Communications Service, it shall be returned to the governmental agency donating the equipment. SECTION 9. The Board shall file quarterly financial statements with the City of Paducah and McCracken County. The statements shall show all monies received and expended by the Board. SECTION 10. This ordinance shall become effective only upon the adoption of a similar ordinance by the Fiscal Court of McCracken County. SECTION 11. This ordinance shall be read on two days and become effective upon publication of title and a certified summary thereof.
