AN ORDINANCE AMENDING SECTION 27-69.5 OF THE CODE OF ORDINANCES OF THE CITY OF
PADUCAH, KENTUCKY
WHEREAS, the City of Paducah has restricted private haulers from collecting,
transporting, or disposal on a commercial, contract or agreement basis, of refuse from
commercial accounts to areas of the city annexed by the city after 1975; and
WHEREAS, Section 27-69.5(2) provides that the City of Paducah will review "all new
accounts under this subsection" "as of July first of each year and a determination made
whether or not the city can provide the required services"; and
WHEREAS, the Board of Commissioners of the City of Paducah has determined that the
city is capable of collecting all refuse within the City of Paducah, and at the best interest
of the citizens of the city would be served by the city being the sole provider of refuse
collections within the City of Paducah; and
WHEREAS, it is also the intent of the Board of Commissioners not to deprive private
collectors of business accounts which they presently serve.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Section 27-69.5(2) is hereby amended to read as follows:
11(2) Dumpster service at commercial accounts. A permit for all volume
services at commercial accounts (except for roll -off service as defined
above) shall be limited to the accounts presently being serviced by
collectors permitted on April 1., 1985, or as may be obtained as new
businesses in the post -1975 city boundaries. All new accounts under this
subsection will be reviewed as of July 1 of each year and a determination
made whether or not the city can provide the required services. No new
accounts may be acquired after July 1, 19:86, and a permit will not be issued
for any accounts not serviced on that date. Each permittee shall submit to
the City Manager a complete list of all accounts serviced within the ci
limits on or before July 31, 1986."
SECTION 2. This ordinance shall be read on two separate days and will become
effective upon publication in full.
