ORDINANCE NO. 86-4-2819
AN ORDINANCE AMENDING SECTION 2-21, VACATION LEAVE GENERALLY, AND 2-22, SICK LEAVE,
OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY
WHEREAS, it has come to the attention of the Board of Commissioners that a
clarification of city policy is needed as to employees accumulating vacation leave and sick
leave while receiving workmen's compensation benefits.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Subsection (a.1) of Section 2-21, Vacation Leave Generally of the
Code of Ordinances of the City of Paducah, Kentucky, be amended and reordained so that said
subsection shall hereafter -read as follows:
"All present employees shall continue to receive vacation at the rate of one and
one-fourth (14) days of vacation for each month of employment with the city except for those
employees who have begun their fifteenth year of service with the city, who shall receive
vacation at the increased rate as hereinafter set forth. Except for members of the police and
fire departments, all employees employed after the date of March 31, 1976, shall receive
vacation time as follows: During the first year of employment, vacation time shall accrue at
the rate of one-half day per month for a total of six (6) days. Between the beginning of the
second and the beginning of the fifth year of employment, employees shall accrue vacation,at
the rate of five -sixth days per month, for a total of ten (10) days per year. From the
beginning of the fifth year to the beginning of the tenth year of employment, the accrual rate
shall be one day per month for a total of twelve (12) days per year. Between the beginning of
the tenth year and the beginning of the fifteenth year of service, the accrual rate shall be
one and one-fourth (114) days per month for a total of fifteen (15) days per year. Between the
beginning of the fifteenth year and the beginning of the twentieth year of service, the
accrual rate shall be one and one-half (12) days per month for a total of eighteen (18) days
vacation per year. From the beginning of the twentieth year through the twenty -fifty year of
service, the accrual rate of vacation will be one and three-fourths (1 3/4) days per month for
a total of twenty-one (21) days per year. For all employees with more than twenty-five (25)
years of service, the accrual rate of vacation shall be two (2) days per month for a total of
twenty-four (24) days per year. An employee may accumulate up to a maximum of fifty (50) days
of vacation at any one time. Upon termination of employment, all employees shall be paid for
any unused vacation leave not to exceed fifty (50) working days.
"After obtaining vacation eligibility, an employee may take vacation as may be
reasonably scheduled with his department head as hereinafter set forth in subsection (f), or
in the case of a department head, as may be scheduled with the city manager. A month in which
a salaried employee is paid for fifteen (15) days or more and a daily or hourly wage employee
is paid for twelve (12) days or more shall be considered as a month of service. Any day in
which an employee receives workmen's compensation benefits from the City of Paducah or its
insurance carrier shall be considered as a day paid under this section."
SECTION 2. Section 2-22, Sick Leave, shall be amended to read as follows:
"(a) Each employee of the city regularly employed on a full-time basis shall be
entitled to sick leave with pay, and each employee shall be entitled to accrue sick leave up

to and including a total of one hundred twenty (120) working days. The accrual of sick leave sha 1 be at
the rate of one and one-half (12) working days for each month of service up to a total of one hun red
twenty (120) working days. No sick leave shall be credited to any employee until such time as he has
worked for the city for six (6) consecutive months, after which time sick leave shall be credited from
the date of employment. A month in which a salaried employee is paid for fifteen (15) days or more, and
a daily or hourly employee is paid for twelve (12) days or more, or a member of a platoon in the fire
department is paid for five (5) twenty -four-hour periods or more, shall be considered a month of Eervice.
A day for which an emplovee receives workmen's compensation benefits from the Citv of Paducah or its
insurance carrier shall be considered a day for which the employee is paid under this section. Any
employee granted a leave of absence for any other purpose shall not continue to accrue sick leave at the
rate prescribed in this section during such absence. When an employee retires or dies, he or his
surviving spouse or his designated beneficiary shall be paid an amount equivalent to one day's re
pay for all sick days he has accumulated over fifty (50) days at the time of such retirement or d ath.
"(d) An employee receiving sick leave with pay who simultaneously receives any compens tion
through a sick benefit plan financed in whole or in part by the city shall receive, for the -duration of
such compensation, only that portion of his regular salary which will, together with such compens tion,
equal his regular salary. However, an
gee shall not be entitled to sick leave for any day for which
the employee receives compensation from the City of Paducah or its insurance carrier under the Key
Workmen's Compensation Law."
SECTION 3. This ordinance shall be read on two separate days and will become effective
publication of title and a certified summary thereof.
