'Mayor -Cherry offered motion 'that, the= executed copies of the Notice of Called'! Meeting to be held at 7:30 p.m., on April 20, 1971, be received and filed. Adopted on call of the`Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Cherry (4). Commiss-ioner V Sher offered- motion, seconded by Commissioner Hornsby, that the Grant Adjustment Notice from the Kentucky Commission on Law Enforcement and Crime Prevention, dated April 5, 1971, pertaining to police communications equipment, Grant No. 70-A-0159, authorizing an increase in the grant amount by $2,433:00, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Cherry (4). Commissioner Fisher offered motion, seconded by Commissioner Hornsby, that the Public Service Company Property Tax Return for the Electric Plant Board of the City of Paducah, Kentucky, dated March 15, 1971, indicating an adjusted book value of $3,893,338.00 in the City of Paducah as of December 31, 1970, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Cherry (4) . Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that the claim of Kenneth Stevens and his wife, Dorothy Stevens in the amount of $48.32 for damages to their vehicle on January 5, 1971, caused by a city police cruiser striking the vehicle on the parking lot of the Dobbs House, be allowed, and that the City Treasurer be authorized to pay said claim after first obtaining a complete and final release. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Cherry (4) . Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners approve the sale by the City of Paducah to Mrs. Ada Paschall of Lot No. 416, in Block No. 6 of the Rushing Addition to Oak Grove Cemetery, and that the City Clerk be authorized to execute a deed of conveyance to said cemetery lot. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Cherry (5). Commissioner Puryear offered motion, seconded by.Commissioner-Hornsby,-"'that the proposed Agreement for engineering services dated April 197ly between the City of Paducah, Kentucky, and Community Program Consultants, -Inc. and Florence -and Hutcheson, Inc. for the design and construction of a waste v a"ter.--`tteatment�,plant- t.o provide 193 Proceedings of Board of Commissioners -City of Pay $20,000.00 Oaklawn Code Enforcement Charges agains Richard Pullen Police Officer Request bids Uniforms for Police Dept. Truck & Conpactor and Stationary Containers Mayor Cherry offered motion, seconded by Commissioner Fisher, that the City Treasurer be, and he is hereby, authorized to pay the sum of $20,000.00 immediately to the Oaklawn Neighborhood Concentrated Code Enforcement Program, to be accounted for as part of the City's previously authorized commitment to said program. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Ch-erry (4). Mayor Cherry offered motion, seconded by Commissioner Fisher, as follows: i✓ I move that the Charges preferred on this date by Paul Holland, Chief of�the Police Department of the City of Paducah, Kentucky, against Richard Pullen-; a- =.member of said Police Department, be received and filed, and I further move that a hearing on said Charges be held on April 23, 1971, at the hour of.4 o'clock p.m., in the Commissic Chamber of the City Hall in Paducah, Kentucky, and that the City Clerk immediately notify the said Richard Pullen of such charges against him, and the date, time and place of said hearing by having a true copy of said charges served upon him, together with the Notice of the date, time and place of hearing. Commissioner Fisher offered motion, seconded by Commissioner Hornsby, that a Resolution entitled "A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR THE SALE TO THE CITY OF PADUCAH, KENTUCKY, OF UNIFORMS AND ASSOCIATED CLOTHING FOR THE MEMBERS OF THE POLICE DEPARTMENT OF SAID CITY, AND PRESCRIBING THE CONDITIONS UPON WHICH PURCHASE SHALL BE MADE", be adopted. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Cherry (4). Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that a resolution entitled "A RESOLUTION APPROVING AND PROVIDING FOR THE EXECUTION OF A PROPOSED CONTRACT FOR AN URBAN BEAUTIFICATION AND IMPROVEMENT PROGRAM, NUMBERED CONTRACT NO. KY B-3 (G), BY AND BETWEEN THE CITY OF PADUCAH, KENTUCKY, AND THE UNITED STATES OF AMERICA", be adopted. Adopted on call of the Roll, Yeas, Commissioners Fisher, Hornsby, Puryear and Mayor Cherry (4). Commissioner Fisher offered motion, seconded by Commissioner Hornsby, that an ordinance entitled "AN ORDINANCE FIXING THE LEVIES AND RATES OF TAXATION ON ALL PROPERTY IN THE CITY OF PADUCAH, KENTUCKY, SUBJECT TO TAXATION FOR MUNICIPAL PURPOSES �. AND FOR SCHOOL PURPOSES FOR THE YEAR 1971, WITH THE PURPOSES OF SAID TAXES THEREUNDER DEFINED",. ,be adopted. Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that an ordinance entitled.>",AN-ORDINANCE ACCEPTING THE BID OF SANCO CORPORATION FOR THE SALE TO THE CITY OF ONE (1) 1971 TRUCK WITH COMPACTOR AND FOR STATIONARY CONTAINERS FOR USE IN THE REFUSE DIVISION OF THE PUBLIC WORKS DEPARTMENT OF THE CITY OF PADUCAH, KENTUCKY,f AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT FOR SUCH PURCHASE, Be introduced and remain _on file for at least one week for public inspection in the completed form in' which it shall be put upon its final passage. AND FLORENCE AND HUTCHESON, INC. TO PERFORM ENGINEERING SERVICES IN CONNECTI WITH THE DESIGN AND CONSTRUCTION OF WASTE WATER TREATMENT PLANT TO PROVIDE SECONDARY WASTE WATER TREATMENT FOR THE CITY OF PADUCAH, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT COVERING SUCH EMPLOYMENT ON BEHALF OF THE CITY",be introduced and remain on file for at least one week for public inspection in the completed form in whic it shall be put upon its final passage. Apportionmen Commissioner Fisher offered motion, seconded by Commissioner Hornsby, that an Ordinance -1971 ordinance entitled "AN ORDINANCE FIXING THE APPORTIONMENT OF THE PUBLIC FUNDS OF THE CIT OF PADUCAH, KENTUCKY, FOR THE YEAR 1971, AND APPROPRIATING THE PUBLIC REVENUE AND INCOME OF THE CITY OF PADUCAH FOR SUCH PURPOSES", be introduced and remain on file for at least �f one week for public inspection in the completed form in which it shall be put upon !� its final passage. ADOPTED ',�'2, Z 1971 °J City Clerk. _ APPR 195 Proceedings of Board of Commissioners Cily of Paducah April 23,'1971 Judgment Charges Richard Pullen At a Called Meeting of the Board of Commissioners held in—Ehe Commission Chamber in the Paducah City Hal -I,,,, Paducah, Kentuckyi, at -4:00 P -M. on April 23,.. 1971 Mayor Cherry presided and upon call of the Roll the following answered to their names: Commissioners Fisher, Harvey, Hornsby, Puryear and: Mayor-Cherryc-(5). The meeting was called for -the purpose of hearing charges preferred against Richard Pullen, a member -of the Police Departmentlof said City, by Paul Holland, C ief of -Police. " The case for the plaintiff was presented by Assistant Corporation Counsel, Samuel Boaz, and'the defendant was represented by Attorney Joseph S. Freeland. The case was called for hearing'and at the conclusion'of all evidence and argument, Mayor Cherry'offered-the following motion which was seconded by Commissioner Fisher: I move that the Board of Commissioners of the City of Paducah, Kentucky, having heard the evidence upon charges preferred against Richard Pullen, a member of the Police Department of said City, by Paul Holland, Chief -of' Police of said City, and being sufficiently advised, adjudges that said Richard Pullen is guilty of the charge of misconduct while off duty, and adjudges that said Richard Pullen is guilty of such conduct justifying punishment within the purview of KRS 95.450 and the Manual of Procedure and the Manual of Rules, Regulations and Duties of the Paducah Police Department governing the conduct of members of the Police Department of said City. It is therefore the judgment of the Board of Commissioners of the City of Paducah, Kentucky=ri that the defendant, Richard Pullen be, and he is hereby, suspended from both duty and pay for a period of thirty (30) days, effective immediately.
