HomeMy WebLinkAbout2009-6-7574ORDINANCE NO. 2009-6-7574 AN ORDINANCE APPROVING THE EXECUTION OF AN ON-LINE GRANT APPLICATION TO OBTAIN A 2009 EDWARD BYRNE MEMORIAL JUSTICE ACCOUNTABILITY GRANT THROUGH THE U.S. DEPARTMENT OF JUSTICE, EDWARD BYRNE MEMORIAL JUSTICE ACT OF 2009, IN AN AMOUNT UP TO $43,984, TO BE USED BY THE PADUCAH POLICE DEPARTMENT AND MCCRACKEN COUNTY SHERIFF'S DEPARTMENT, AND FURTHER, AUTHORIZING THE MAYOR TO EXECUTE AN INTERLOCAL AGREEMENT WITH MCCRACKEN COUNTY FOR SAID GRANT BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The City of Paducah hereby approves the execution of an on-line grant application to obtain a 2009 Edward Byrne Memorial Justice Accountability Grant through the U.S. Department of Justice, Edward Byrne Memorial Justice Act of 2009, in an amount up to $43,984, to be used by the Paducah Police Department and McCracken County Sheriff's Department. The funds will be allocated 57% ($25,071) to the City Police Department and 43% ($18,913) to the McCracken County Sheriff's Department based on 911 -call volume. SECTION 2. The City of Paducah hereby accepts funds in an amount up to $43,984, as approved in Section 1 above. SECTION 3. The Mayor is hereby authorized to execute an Interlocal Agreement between the City of Paducah and McCracken County to act as the legal recipient and fiscal agent for the JAG funds and to disburse a total of $18,913 of the JAG funds to McCracken County. SECTION 4. Pursuant to KRS 83A.060, the City Commission suspends the requirement of a second reading and publication of this Ordinance. As grounds therefore, the City Commission does hereby declare an emergency to exist in order to meet the application deadline in a timely manner. ATTEST: Tammara S. Brock, City Clerk, June 23, 2009 Published by the Paducah Sun, June 29, 2009 \ord\plan\grant\police — 2009 Justice Assistance Edward Byrne Interlocal Agreement Between the City of Paducah, Kentucky and McCracken County, Kentucky Recovery Act: Justice Assistance Grant (JAG) Program Award This Interlocal Agreement is made and entered into this the 25''' day of June, 2009, by and between The City of Paducah with the address 300 South Fifth Street and County of McCracken, Kentucky, with the address of 301 South Sixth Street, Paducah, Kentucky 42003-1700. WHEREAS, Kentucky Revised Statutes §65.210 et seq. (Interlocal Cooperation Act) allows local governmental units to make the most efficient use of their resources by enabling them to cooperate on the basis of mutual advantage; and WHEREAS, The City of Paducah and McCracken County, acting by and through their respective governing bodies, have determined that the public welfare, safety, interest and good shall be promoted by this Agreement, pursuant to which the City of Paducah has applied to the Bureau of Justice Assistance JAG Program for a formula grant award; and WHEREAS, the Bureaus of Justice Assistance has provided a JAG award in the amount of $49,984 to the City of Paducah; and WHEREAS, each governing body finds that the that the legal payments in performance of this Agreement are in keeping with JAG requirements and in the best interests of both parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing parties for the services or functions under this Agreement; and WHEREAS, The City agrees to provide the County $18,913 of the JAG award for the Sheriff's Department In -Car Equipment Program, and WHEREAS, the City and the County believe it to be in their best interests to reallocate the JAG funds NOW, THEREFORE, the City and the County agree as follows: 5. The City of Paducah acting as the legal recipient and fiscal agent for the JAG funds agrees to pay McCracken County a total of $18,913 of JAG funds. 2. The County agrees to use the $18,913 of JAG funds for the Sheriff's Department Equipment Capacity Enhancement Program until June 25, 2011. 3. Each party to this Agreement will be responsible for it's own actions in providing services under this agreement and shall not be liable for any civil liability that may arise from the furnishing of the services of the other party. 4. The parties to this Agreement do not intend for any third party to obtain a right by virtue of the Agreement 5. By entering into this agreement, the parties do not intend to create any obligations express or implied other than those set out herein, further, the Agreement shall not create any rights in any party not a signatory hereto.
