Twitty City of Paducah June 3, 1975 No. At a Called Meeting of the Board of Commissioners held in the Commission Chamber of the City Hall, Paducah, Kentucky, at 4: 30 p.m., on June 3, 1975, Mayor McNutt presided and upon call of the Roll the following answered to their names: Commissioners Coleman, Hornsby, Puryear and Mayor McNutt (4) , Commissioner Brumley was absent. Mayor McNutt offered motion, seconded by Commissioner Hornsby, that the executed copies of the Notice of Called Meeting to be held at 4: 30 p.m. , on June 3, 1975, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Coleman, Hornsby, Puryear and Mayor McNutt (4) . Commissioner Coleman offered motion, seconded by Commissioner Hornsby, that upon recommendation of the City Manager the following personnel changes be made: 1. Mike Finnell, collector in the Refuse Department, be promoted to the position of truck driver in the Street Department, at a salary of $ 3.46 per hour, retroactive to May 26 , 1975. 2. Robert Puckett be employed as collector in the Refuse Department at a salary of $3.23 per hour, retroactive to May 27, 1975. 3. Eugene Forrester, equipment operator "B" in the Street Department, be promoted to equipment Operator "A" in said department, at a salary of $3.96 per hour, retroactive to May 26 , 1975. 4. Thomas I. Tucker, laborer in the Street Department, be promoted to street repairman in said department, at a salary of $3.56 per hour retroactive to May 26, 1975. 5. Larry Myers, equipment operator "C" in the Cemetery Department, be promoted to equipment operator "B" in the Street Department, at a salary of $3.86 per hour, retroactive to May 26, 1975. 6. Larry Roberts, sewer maintenance man in the Street Department, be promoted to equipment operator "C" in the Cemetery Department, at a salary of $3.76 per hour, retroactive to May 26, 1975. 7. James R. Thompson, Director, Refuse Department, be granted a leave of absence for the period June 23, 1975 to July 25, 1975. 8. Richard Boyarski , lieutenant in the Paducah Fire Department, be promoted to captain in said department, to fill the vacancy created by the retirement of Captain Calvin Cranor, , effective June 9, 1975. r 9. Danny Taylor, firefighter in the Paducah Fire Department, be promoted to lieutenant in said department, effective June 9, 1975. 10. The following temporary employees in the Parks and Recreation Department, be terminated,, retroactive to June 1, 1975: Annelle Travis Mary Yancy Susan Stewart Jerel Baucum Clinton Strohmeir Ellen Dean Commissioner Coleman offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners approve the sale by the City of Paducah to Jack Harrigan of two grave spaces (8 by 10 feet) located in the northwest corner of Lot No. 284 in Section 18 of Oak Grove Cemetery, for the sum of $200.00 (Receipt No. 1689) , and that the City Clerk be authorized to execute a deed of conveyance to said cemetery graves. Commissioner Coleman offered motion, seconded by Commissioner Hornsby, that the liability insurance policy issued by The Aetna Casualty and Surety Company covering work done by Paul Duncan for a period of one year from April 30 , 1975, be received, approved and filed. Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that the reports of the Paducah Water Works for the month of May,, 1975 , be received and filed. Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that a copy of a motion adopted by the Paducah Planning Commission on May 19, 1975, recommending changing the name of South 16th Street (around Guthrie Pit) to McBride Avenue, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Coleman, Hornsby, Puryear and Mayor McNutt (4) . Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that the executed copy of the contract between the City of Paducah and Belmont Equipment Company for sale to the City of two Cushman Police Vehicles, be received and filed. Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that the Summary of income and expenses submitted by the Kelley Transportation Company, Inc. for bus service within the City of Paducah for the month of April, 1975 , be received and filed. Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that the application for Certificate of Compliance as filed by Comcast Cable of Paducah, Inc. before the Federal Communications Commission, Washington, D. C. for new CATV operations in the City of Paducah, Kentucky, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Coleman, Hornsby, Puryear and Mayor McNutt (4) . Commissioner Coleman offered motion, seconded by Commissioner Hornsby, that a resolution entitled "A RESOLUTION REQUESTING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR SALE TO THE CITY OF PADUCAH OF AN AIR COMPRESSOR TO BE USED BY THE PADUCAH FIRE Proceedings of Board of Commissioners City of Paducah June 3. 1975 DEPARTMENT , AND PRESCRIBING THE MANNER IN WHICH BIDS SHALL BE SUBMITTED" , be adopted. Commissioner Coleman offered motion, seconded by Commissioner Hornsby, that an ordinance entitled "AN ORDINANCE AMENDING CERTAIN SECTIONS OF CHAPTER 72 'CABLE COMMUNICATIONS' OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY", be adopted. Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that an ordinance entitled "AN ORDINANCE REPEALING SECTION 40.023 'AMORTIZATION OF NONCONFO JUNK YARDS' OF ARTICLE IV OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY be adopted. Adopted on call of the Roll, Yeas, Commissioners Coleman, Hornsby, Puryear and Mayor McNutt (4) . Mayor McNutt offered motion, seconded by Commissioner Hornsby, that an ordinance entitled "AN ORDINANCE AMENDING THE STATEMENT OF ANTICIPATED REVENUE OF THE CITY OF PADUCAH, KENTUCKY, FOR THE PERIOD FROM JANUARY 1, 1975 THROUGH JUNE 30, 1975; REVISIN AND AMENDING THE APPROPRIATION OF THE PUBLIC FUNDS, REVENUE AND INCOME ON HAND, AND COLLECTED AND TO BE COLLECTED FOR SAID PERIOD; AUTHORIZING THE TRANSFER OF UNUSED APPROPRIATIONS FOR ONE PURPOSE TO ANOTHER PURPOSE; MAKING SUCH TRANSFERS; APPROPRIATING AVAILABLE REVENUES NOT INCLUDED IN THE BUDGET FOR SAID PERIOD; FIXING THE APPORTIONMENT OF THE PUBLIC FUNDS FOR THE PURPOSES SPECIFIED THEREIN; AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH", be introduced and remain on file for public inspection until the notice of the transfer of funds as provided herein shall have been published as required by law , and shall be put upon its final passage after such publication. Mayor McNutt offered motion, Seconded by Commissioner Puryear, that an ordinance entitled "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY LOCATED AT 1600 - 1612 JEFFERSON STREET, AND AMENDING THE PADUCAH ZONING ORDINANCE -1971 SO AS TO EFFECT SUCH REZONING", be adopted. Hornsby: Mayor McNutt offered the following motion which was seconded by Commissioner I move that the following Findings of Fact & Conclusion be adopted by the Board of Commissioners pursuant to and as a result of the public hearing held by the Board of Commissioners on May 29, 1975 on the ordinance entitled "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY LOCATED AT 1600 - 1612 JEFFERSON STREET , AND AMENDING THE PADUCAH ZONING ORDINANCE -1971 SO AS TO EFFECT SUCH REZONING": No. 415 Amend certain sections of Chapter 71 "Cable Communications" Repeal Section 40.023 "Amortization of nonconforming junk years" Reapportionment Ordinance January 1, 1975 to June 30, 1975 Rezone property at 1600 - 1612 Jefferson Street LOST Deny request for rezoning property at 1600 - 1612 Jefferson Street 416 Proceedings of Board of Commissioners Qy of Paducah No. June 3, 1975 1. That the Paducah Planning Commission on May 5, 1975, adopted a resolution recommending that the zone classification of the real property located at 1600 - 1612 Jefferson Street be changed from R-2, Low/Medium Density Residential Zone, to R-3, Medium Density Residential Zone; 2. That the testimony presented at the hearing of May 29, 1975, the Board of Commissioners establishes that Jefferson Street from 14th to 28th Streets remains as one of the City of Paducah's fine old residential areas; 3. That from an examination of the comprehensive zoning plan for the City of Paducah, it is found that there is no recommended deviation from the totally residential nature of this area of Jefferson Street; 4. That from the testimony presented at the hearing of May 29, 1975, it is apparent that the vast majority of those persons owning residential property in and about the area sought to be rezoned object to the proposed rezoning; 5. That from the testimony presented at the hearing of May 29, 1975 it is found that the building complex proposed by Home Federal Savings & Loan Association can be effectively accomplished without the additional public parking area which is proposed on the subject real estate. NOW THEREFORE, be it concluded by the Board of Commissioners of the City of Paducah, Kentucky , that the rezoning of the property located at 1600 - 1612 Jefferson Street from R-2, Low/Medium Density Residential Zone, to R-3, Medium Density Residential Zone, as recommended by the Paducah Planning Commission, be denied on the grounds that a public parking area situated at said location would be detrimental to the adjoining residential area.
