Mayor McNutt offered motion,-, seconded by Commissioner Hornsby; that the executed copies of the Notice of Called Meeting to be held at 4: 30 p.m. , on December.28, 1973, be received and filed. Adopted on call, of the Roil-, Yeas, Commissioners, Harvey,. Hornsby, Lambert, Puryear and Mayor. McNutt (5) . Commissioner Harvey offered motion, seconded by Commissioner- Hornsby, 'that the following bids for sale to, the City' -of tires and tubes, forothe'per-d`January'1 1974Tto December 31, .1974, be' received and filed: r oo ric tore Goodyear Service 'Stores - Adopted on call of the Roll, Yeas, Commissioners Harvey, Hornsby, Lambert, Puryear and Mayor McNutt .(5) . Commissioner Hornsby offered rriotion, seconded -by -Commissioner Harvey -as follows: WHEREAS -,-five Covenants of Restrictions were executed and entered into by and between various parties and owners -of property in the Tyler,, Park Area of Paducah-, asparties of -the first part, and the City -of Padtca'h,-Ihe Paducah=McCrackeni County Planning Commission and the Urban Renewal- and Community Development Agency as pa"r"ties of the second part; and were recorded in the McCracken' County Court'Clerk's office`on May 7,. 1.964', in'Deed-Book 455, pages -,---,­- 295,-° 311; 320, 329; and "339 and except for the parties to -the _a reement the -documents have verbatim provisions-; and WHEREAS, the properties affected' by the Covenants of Restrictions is now zoned- B-3 and the ordinances -of the City of Paducah pertaining to .a,B-=-3 Classification provide "sufficient - protection for properties in said zone, and, WHEREAS, there is, a --legitimate question regarding the legality of .said covenants`; yet they provide a cloud on the title in use and enjoyment of the affected property, and WHEREAS, the Covenants provide that the restrictionsset out shall be'in effect until January 1, 1984, "unless sooner released by the second parties", and WHEREAS, the Planning Commission has considered the foregoing and other evidence and recommends release of said Covenants of Restrictions, NOW, THEREFORE, I move that the City of Paducah accept' the recommendation of the Planning Commission and join with them, subject to the concurrence of the Urban Renewal and Community Development Agency, in collectively releasing of said Covenants of Restrictions, and•I further move that the Mayor be authorized to execute any documents required for Proceedings of Soard'of, Commissioners City of File Traffic AgrE Bureau of Highw Park Avenue - Hinkleville Road Larry Myers Civil Service Robert C. Commissioner Lambert offered motion, seconded by Commissioner Puryear, that the executed copy of the Traffic Agreement between the Bureau of Highways and the City of Paducah for the Hinkleville Road -Park Avenue Project, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Harvey, Hornsby, Lambert, Puryear and Mayor McNutt (5) . Commissioner Lambert offered motion, seconded by Commissioner Puryear, that upon the recommendation of the City Manager, the following personnel changes be made: 1. Larry Myers, truck driver in the Street Department, be placed under civil service for such position, retroactive to December 24' 1973. 2. 'Robert C. ,Cher'ry', Jr.,, a member of -the Paducah Fire Department-, be granted an educational leave of absence for the period January 1, 1974 to January 1, 1975, for Purposes of full time study toward an associate degree in fire prevention. 3 That Robert Lowell Patton be employed as Assistant Electrical '& Building Inspector at a salary of $700.00 per month plus an additional 10 per mile auto allowance, effective January Z, 1974. The position hereby created shall be paid -for from the Federal Revenue Sharing Trust Fund, but the position created shall provide -all. benefits as are now provided :for the full time permanent employees of the City of Paducah. 4. The resignation of Linda R. Ryan as temporary clerk in the Finance Department, be accepted: 5` Patty Sargent'be employed as temporary clerk in the Finance Department, at a salary of $275.00 per month, effective January 14, 1974. 6. James Clay Turner, an Applicant -Candidate in the Fire Department, has satisfactorily completed the 60 day training period as such Applicant -Candidate as provided by ordinance, he is hereby appointed a firefighter in said department, at a salary of $530.00 per month, effective January_ 1, 1974. William Howerton, dated December 14, 1973, proposing to perform architectural services relating I I to the TVA Townlift proposal .be received and filed. Mayor McNutt offered motion, seconded by Commissioner Hornsby, that the time for completion of the work of the Board of Equalization be extended to and including January 7,19 74, or so much thereof as is necessary to complete their work. Commissioner Hornsby offered -motion; seconded by Commissioner Harvey, that an ordinance entitled "AN'ORDINANCE APPROVING THE FINAL -REPORT OF THE PADUCAH PLANNING COMMMISSION RESPECTING THE REZONING OF CERTAIN PROPERTY LOCATED ON NORTH 10TH STREET BETWEEN B' STREET AND FLOURNOY STREET, AND AMENDING THE PADUCAH ZONIPG ORDINANCE -1971 SO AS TO EFFECT SUCH REZONING", be adopted. Commissioner Puryear offered motion, seconded by Commissioner Lambert, that an ord: entitled "AN ORDINANCE ACCEPTING THE BID -OF DUNCAN INDUSTRIES -FOR SALE TO THE CITY OF APPROXIMATELY THIRTY-SIX MANUALLY OPERATED PARKING METERS, AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT FOR SUCH PURCHASE", be introduced and remain on file for at least one week4or public inspection in the -completed form in which it shall be put upon its' final passage. THE PUBLIC FUNDS, REVENUE AND INCOME ON HAND AND COLLECTED AND TO.,BE :COLLECTED IN SAID YEAR; AUTHORIZING THE TRANSFER OF UNUSED APPROPRIATIONS FOR ONE PURPOSE TO ANOTHER.
