Homestead Tax ExL6mp- tion Board of Commissioners _ City of Paducah January 23, 1973 At a Regular Meeting of the Board of Commissioners held in the Commission Chamber in the City Hall, Paducah, Kentucky, at 7:30 p.m., on January 231, 1973, Mayor McNutt presided and upon call of the Roll the following answered to their names: Commissioners Hornsby. Lambert, Puryear and Mayor McNutt (4). Mayor McNutt offered motion that the reading of the Minutes for December 19, 22 & 29, 1972 and January 8 and 16, 1973 be waived and that the Minutes of said meetings prepared by the City Clerk be approved as written. Adopted on call of the Roll, Yeas, Commissioners Hornsby, Lambert, Puryear and Mayor McNutt (4) . Mayor McNutt offered motion, seconded by Commissioner Hornsby, that the petition addressed to Mayor McNutt and Members _of the City Commission requesting that they continue to work against the management of the Fourth Street Cinema in showing X-rated films, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Hornsby, Lambert, Puryear and Mayor McNutt (4) . Commissioner Hornsby offered motion, seconded by Commissioner Lambert, that the Certificate of Insurance issued by The Fidelity and Casualty Company of New York, to Harper & Arterburn and the City of Paducah, Kentucky, for a period of one year from January 1, 1973, be received, approved and filed. Commissioner Hornsby offered motion, seconded by Commissioner Lambert that the executed copy of the contract between the City and Gulf Oil Company, for sale to the Cil of its requirement of regular and ethyl gasoline, motor oil, diesel fuel, chassis �y lubricant, gear lube oil, hydraulic oil, kerosene and anti -freeze from January 1, 1973 ! through December 31, 1973, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Hornsby, Lambert, Puryear and Mayor McNutt (4) . Commissioner Hornsby offered motion, seconded by Commissioner Lambert, as follows: WHEREAS, the citizens of the Commonwealth of Kentucky have recently seen fit through the enactment of a Constitutional Amendment to grant a homestead exemption to the elderly citizens of this Commonwealth, so that they may fully enjoy their latter years without oppressive tax burdens that deplete their limited and fixed income, and WHEREAS, due to unfortunate circumstances many of our citizems eligible for this homestead exemption have recently incurred an increase in the real property assessment on their residences, and WHEREAS, I am of the opinion that the effect of these circumstances is contrary to the spirit and intent of the homestead exemption act and that such circumstances have discriminated against and have deprived the elderly citizens of the tax relief that they so justly deserve, and WHEREAS, I am desirous of having the City concentrate its efforts to determine whether this Board of Commissioners can adopt any legal measures which will correct I Proceedings of. Board of Commissioners No. 9 City of Paducah January 23, 1973 these unfortunate circumstances and provide to the senior citizens of Paducah, Kentucky the full measure of tax relief for their homes. NOW THEREFORE, I move that the Corporation Counsel of the City of Paducah, Kentucky, be directed by the Board of Commissioners, to conduct a study of the applicable law and authorities governing a city of the second class, to determine whether the governing body of that city can legally adopt, by ordinance or other appropriate measures, the necessary rules and regulations to authorize the real property assessments of all persons over the age of 65 years be adjusted to reflect the value assessed to that property on July 1, 1972, and that further that the Corporation Counsel of the City of Paducah, Kentucky, consult with the Commonwealth of Kentucky Department of Revenue and the office of the Attorney General and other such agencies as he may select, and that he submit to the Board of Commissioners a written opinion detailing his findings as soon as possible. Commissioner Puryear offered motion, seconded by Commissioner Lambert, that the Standard Form of Agreement between owner and architect submitted by Gresham & Kerr, John Keeling Associates, for professional architectural services to be rendered in the design and construction of a fire station to be located at 17th and Broadway in Paducah, Kentucky, be received and filed with the Minutes of this meeting. Adopted on call of the Roll, Yeas, Commissioners Hornsby, Lambert, Puryear and Mayor McNutt (4) . Commissioner Puryear offered motion, seconded by Commissioner Lambert, that the bid of Ray H. Mullen Motor Company, Inc. for sale to the City of one 1973 medium size four door automobile for use by the Mayor, be received and filed. Adopted on call of the Roll, Yeas, Commissioners Hornsby, Lambert, Puryear and Mayor McNutt (4) . Commissioner Hornsby offered motion, seconded by Commissioner Lambert, that a resolution entitled "A RESOLUTION AUTHORIZING THE CITY MANAGER TO ADVERTISE FOR BIDS FOR THE CONSTRUCTION OF SECONDARY WASTEWATER TREATMENT FACILITIES FOR THE CITY OF PADUCAH", be adopted. Adopted on call of the Roll, Yeas, Commissioners Hornsby, Lambert, Puryear and Mayor McNutt (4) . Commissioner Lambert offered motion, seconded by Commissioner Puryear, that an ordinance entitled "AN ORDINANCE ADOPTING THE 1972-73 EDITION OF THE NATIONAL FIRE CODE; VOLUMES 1 THROUGH 10, RECOMMENDED BY THE NATIONAL FIRE PROTECTIVE ASSOCIATION", be adopted. KY -T9-3 BETWEEN THE CITY OF PADUCAH, KENTUCKY, AND THE UNITED STATES OF AMERICA" , be introduced and remain on file for one week for public inspection in the completed form in which it shall be put upon its final passage.
