HomeMy WebLinkAbout2009-5-7549ORDINANCE NO. 2009-5-7549 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE CONTRACT MODIFICATION NO.2 WITH JJR, LLC FOR PROFESSIONAL ENGINEERING SERVICES FOR THE TRANSIENT BOAT LANDING DOCK, RIVERFRONT DEVELOPMENT PHASE I PROJECT WHEREAS, by Ordinance No. 2007-8-7313, the City authorized the execution of an agreement with JJR, LLC in an amount not to exceed $559,600.00 for professional engineering services for the design of the Transient Boat Landing Dock, Riverfront Development Phase I Project; and WHEREAS, by Ordinance No. 2008-8-7453 the City authorized a contract modification in the amount of $20,240 for a survey required by the United States Fish and Wildlife Services (USFWS) to be conducted of the Ohio River Bottom within the project area to determine the presence/absence of threatened or endangered mussels, therefore increasing the total contract amount to $579,840.00; and WHEREAS, the survey has now been completed and threatened/endangered mussel species habitats were encountered. Therefore, the USFWS now requires a Biological Assessment (BA) and a Biological Opinion (BO) to be completed. This environmental process is proposed by JJR to be $31,500 for the BA and $45,000 for the BO, with the total costs not to exceed $76,500.00; and WHEREAS, JJR has completed the design of the Transient Boat Landing Dock for Phase I and in order for boats to refuel a Marina Service building along with utilities is necessary for the next phase of the design. JJR has proposed the total design fees associated with the Marina Building to be $138,400 as follows: Task 1—Marina Services building, Platform and Flotation Design -- $63,800; Task 2 – Utility Systems (Fuel, Sanitary Sewer, Fire Protection, Electrical -- $66,400 and Task 3 – Bidding Services for the Marina Building and Utilities -- $8,200; and WHEREAS, in order for the City to proceed, contract modification no. 2 is necessary in an amount not to exceed $214,900, therefore increasing the current contract amount to $794,740.00. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Mayor of the City of Paducah is hereby authorized and directed to execute Contract Modification No.2 with JJR, LLC in an amount not to exceed $214,900 for the required Environmental BA and BO and the design for the floating Marina Service Building and dock utilities for the Transient Boat Landing Dock, Riverfront Development Phase I Project, increasing the total contract amount to $794,700. SECTION 2. This expenditure shall be charged to the RF 2006 HUD Grant, project account DT0015. SECTION 3. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: AVMTkaw S . &n. Tammara S.
