HomeMy WebLinkAbout07/11/78No. 370 Proceedings of Board of Commissioners City of Paducah July 11, 1978 At a meeting of the Board of Commissioners held at 6:30 P.M., on July 11, 1978, Mayor Murphy presided and upon call of the Roll the following answered to their names: Commissioners Coleman, Grumley, Meeks, Puryear and Mayor Murphy (5) . Step 4 of a grievance hearing, submitted by Robert M. Reed, Street Department, was conducted and after hearing sworn testimony from Charles Hobbs, Robert Reed and Gene Ruoff, Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board retire to Executive Session to discuss the matter. Adopted on call of the Roll, Yeas, Com- missioners om-missioners Coleman, Grumley, Meeks, Puryear and Mayor Murphy (5) . Upon the Board reconvening, Commissioner; Grumley offered the following motion, seconded by Commissioner Puryear: "The Board of Commissioners having conducted a hearing on the grievance of Robert Reed and having heard sworn testimony from witness for the grievance and for the City does hereby find that the proposed change of the Class B mechanic from the evening shift to the day shift as proposed by the City is a proper exercise of management rights and does not "demote" or otherwise discriminate against Mr. Reed. Based on the foregoing, I therefore move that the grievance be denied". Adopted on call of the Roll, Yeas, Commissioners Coleman, Grumley, Meeks, Puryear and Mayor Murphy (5) . The next business to come before the Board was the public hearing on the rezoning of property on South 21st and B Streets (Amos Wahl) . Speaking on behalf of the zone- change was Charles "Chubby" Wahl, and speaking against the zone change was Bob Langston and Virgie Bailey. Afterwards, Commissioner Grumley offered motion, seconded by Commissioner Coleman, I move that the matter be tabled for further consideration. Adopted on call of the Roll, Yeas, Commissioners Coleman, Grumley, Meeks, Puryear and Mayor Murphy (5) . Mayor Murphy offered motion, seconded by Commissioner Puryear, that the reading of the Minutes for June 27, 1978 and July 7, 1978 be waived and that the Minutes of said meeting prepared by the City Clerk be approved as written. Commissioner Coleman offered motion, seconded by Commissioner Grumley, that upon recommendation of the City Manager, I move that the following personnel changes be made: 1. The resignation of Daryl Stalls, patrolman in the Police Department, be received and accepted, retroactive to July 1, 1978. Commissioner Coleman offered motion, seconded by Commissioner Grumley that the following claims be approved, and that the City Treasurer be authorized to pay said claims after first obtaining a complete and final release. 1. Interstate Brands Corp. in the amount of $54.91 for damages to their truck caused by the brakes failing on a Cushman, driven by Jessie Cole, and the Cushman rolling into the corner of the cab of the truck, on May 24, 1978. 2. Maudell Sublett in the amount of $4.00 for damages to two concrete blocks, caused by a Cushman running over the blocks, during the winter of 1978. Agreement between the City and the Commonwealth of Kentucky -for a feasibility study on a movable floodwall between Jefferson and Kentucky Avenue in Paducah, Kentucky. 6. The resignation of Leroy Harris, collector in the Refuse Department, be received and accepted, retroactive to June 28, 1978. William C. Owen be employed as maintenance helper in the Maintenance Departmen at a salary of $4.75 per hour, retroactive to July 3, 1978. Mayor Murphy offered motion, seconded by Commissioner Grumley, that upon recom- mendation of the City Manager, I move that the following personnel changes be made: 1. The initial 60 day training period of the total 120. days training program as required in Chapter 12, Section 12-48, Code of Ordinances be waived for Larry Holland, applicant candidate in the Fire Department. Larry Holland shall be assigned for training with a regular platoon effective July 17, 1978 and shall be paid at the rate of $2.30 per hour until the completion of his training and probationary period. Commissioner Coleman offered motion, seconded by Commissioner Grumley, as follows: WHEREAS, Kentucky Revised Statutes permit the adoption of -resolutions by reference to a summary thereof; I therefore move that a resolution adopting and appooving the execution of a contract between the incorporated area of Paducah and the Bureau of Highways, for the fiscal year beginning July 1, 1978, and accepting all streets listed therein as being streets for improvement, for a projected net apportionment of $205,319.00, and as appended in full hereto be adopted according to law. Commissioner Meeks offered motion, seconded by Commissioner Puryear, as follows: WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference to a summary thereof; I therefore move that an ordinance authorizing the City Manager to execute a contract with Florence & Hutcheson, Inc . , for a sum not to exceed $19,000.00 for engineering services for a sewer system to be located in the Phillips Park Subdivision, located in the City of Paducah, Kentucky, and as appended in full hereto be introduced and adopted according to law; this being the second and final reading. Commissioner Puryear offered motion, seconded by Commissioner Meeks, as follows: WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference to a summary thereof; I therefore move that an ordinance authorizing the City Manager to purchase vehicle liability insurance for 1978-79 with Bradshaw & Weil, Inc., for a premium of $35,923.00, and as appended in full hereto be introduced and adopted according to law. Mayor Murphy offered motion, seconded by Commissioner Puryear, as follows: WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference to a summary thereof; I therefore move that an ordinance approving the final report of the Paducah Planning Commission respecting the rezoning of property located between Broadway and Jefferson Streets, east of North 30th Street, and as appended in full hereto be introduced and adopted according to law. Mayor Murphy offered motion, seconded by Commissioner Grumley, as follows: WHEREAS, Kentucky Revised Statutes permit the adoption of ordinances by reference to a summary thereof; I therefore move that an ordinance authorizing the City Manager to purchase Workmen's Compensation Insurance for 1978-1979 through the Kentucky Association of Counties - Kentucky Municipal League, for an estimated premium of $152,375.00, and as appended in full hereto be introduced and adopted according to law.
