AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR
TO EXECUTE A CONTRACT WITH DANNY COPE AND SONS EXCAVATING,
LLC FOR RENTAL OF VARIOUS EQUIPMENT FOR THE 2009-2010 CALENDAR
YEARS
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized and directed to execute
a contract with Danny Cope and Sons Excavating, LLC for rental of the following
equipment with the option of a one-year extension, at the following hourly rates for the
2009-2010 calendar years:

Said bid being in substantial compliance with the bid specifications and
advertisement for bids, as contained in the bid of Danny Cope and Sons Excavating, LLC
of March 25, 2009.
SECTION 2. Expenditures for the City's equipment rental program shall
be charged to various accounts.
SECTION 3. The contract shall be binding upon the City and the
Contractor, his partners, successors, assigns and legal representatives for the 2009-2010
calendar years ending December 31, 2010. Neither the City nor the Contractor shall have
the right to assign, transfer, or sublet their interests or obligations hereunder without
consent of the other party. The term of the contract shall be renewable for an additional
one-year term, ending December 31, 2011, upon the mutual agreement of both parties.
The Board of Commissioners of the City of Paducah hereby authorizes the City Engineer,
in his sole discretion, to exercise this renewal option. This renewal option shall be
exercised by both parties executing and delivering the written One -Year Renewal
Agreement prior to the expiration of the original term of the contract. The City reserves
the right to rent various equipment at the quoted prices until the One -Year Renewal

Agreement has been executed by the parties. However, in no case shall the Contractor be
bound to rent the equipment at these prices past December 31, 2010.
SECTION 4. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.
