At a Called Meeting of the Board of Commissioners held in the Commission Chamber,
City Hall, Paducah, Kentucky, at 7:00 P.M. on May 31, 1983, Mayor Penrod presided and upon
call of the Roll, the following answered to their names: Commissioners Coleman, Flynn,
Ford, Viterisi and Mayor Penrod (5).
Commissioner Coleman offered motion, seconded by Commissioner Flynn, that the ex -
ecuted copies of the Notice of Called Meeting to be held at 7:00 P. M. on May 31, 1983, be
received and filed. Adopted on call of the Roll, Yeas, Commissioners Coleman, Flynn, Ford,
Viterisi and Mayor Penrod (5).
A grievance filed by Paul Moore, Chief Inspector in the Safety & Street Con-
struction Department was heard. The Board's decision was to take his grievance under
advisement and notify him of their decision on or before the regular meeting on June 14,
1983.
Commissioner Flynn offered motion, seconded by Commissioner Coleman, that the FY
1984 Budget as submitted by the City Manager, be received and filed. Adopted on call of the
Roll, yeas, Commissioners Coleman, Flynn, Ford, Viterisi and Mayor Penrod (5).
Commissioner Viterisi offered motion, seconded by Commissioner Ford, that the
following personnel changes be made:

Commissioner Ford offered motion, seconded by Commissioner Viterisi, that the
Board of Commissioners adopt a Resolution expressing their sincere sorrow at the death of
Mr. Fred Nagel and also expressing their posthumous appreciation for the nine years of
service and leadership as chairman of the Paducah Cable Communications Authority. (This
Resolution was read in full). Adopted on call of the Roll, Yeas, Commissioners Coleman,
Flynn, Ford, Viterisi and Mayor Penrod (5).
Commissioner Coleman offered motion, seconded by Commissioner Flynn, that' the
Board of Commissioners introduce the following ordinance: (Adopt 1983 Edition of Ky.
Building Code. This ordinance was read in full). Adopted on call of the Roll, Yeas,
Commissioners Coleman, Flynn, Ford, Viterisi and Mayor Penrod (5).
Commissioner Flynn offered motion, seconded by Commissioner Coleman, that the
Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE OF THE CITY OF PADUCAH
DECLARING THE COMMERCIAL EXPLOITATION OF OBSCENE MOTION PICTURE FILMS AND OBSCENE PUBLI-
CATIONS TO BE CONTRARY TO PUBLIC HEALTH, SAFETY, AND GENERAL WELFARE, AND A PUBLIC NUISANCE;
DECLARING ANY PLACE DISPLAYING OR EXHIBITING SUCH OBSCENE MOTION PICTURE FILMS OR PUBLI-
CATIONS TO BE A PUBLIC NUISANCE PER SE; MAKING ALL OBSCENE MATTER AND PUBLICATIONS POSSESSED
IN SUCH PLACES A PUBLIC NUISANCE PER SE; PROVIDING FOR NOTICE AND LEGAL PROCEEDINGS TO ABATE
THE SAME; AND PROVIDING A PROCEDURE FOR ASSESSMENT AND COLLECTION OF COSTS OF ABATEMENT".
This ordinance is summarized as follows: Create Article VII of Chapter 19 to the Code of
Ordinances of the City of Paducah by declaring pornography to be a public nuisance, provid-
ing for forfeiture of pornography materials and monies for operating pornography places, and
for filing for a declaration of a business dealing in pornography a public nuisance in
McCracken Circuit Court. Adopted on call of the Roll, Yeas, Commissioners Coleman, Flynn,
Ford, Viterisi and Mayor Penrod (5).
Mayor Penrod offered motion, seconded by Commissioner Coleman, that the Board of
Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING ORDINANCE NO. 83-4-2376,

ENTITLED,'AN ORDINANCE ADOPTING THE CITY OF PADUCAH, KENTUCKY ANNUAL BUDGET FOR THE FISCAL YEAR JULY 19
1982 THROUGH JUNE 309 19839 BY ESTIMATING REVENUES AND RESOURCES AND APPROPRIATING FUNDS FOR THE
OPERATION OF CITY GOVERNMENT."' This ordinance is summarized as follows: Amending the 1982-38 budget
from $10,384,000 to $11,738,000, and the total expenditures from $10,382,281 to $11,413,201, and de-
claring an emergency to exist. Adopted on call of the Roll, Yeas, Commissioners Coleman, Flynn, Ford,
Viterisi and Mayor Penrod (5).
Commissioner Ford offered motion, seconded by Commissioner Viterisi, that the
Board of Commissioners go into Executive Session for the purpose of discussions or hearings which might
lead to the appointment, discipline or dismissal of employees. Adopted on call of the Roll, Yeas,
Commissioners Coleman, Flynn, Ford, Viterisi and Mayor Penrod (5).
Upon conclusion of the Executive Session, the Board reconvened in the Commission Chamber
whereupon the Mayor announced there was no further business.
