HomeMy WebLinkAboutMO # 053Vil MUNICIPAL ORDER N053 A MUNICIPAL ORDER RECITING THE NEED FOR ACQUIRING A RIGHT OF WAY EASEMENT OVER A CERTAIN PARCEL OF LAND OWNED BY C. L. ASHBURN AND WIFE, ALICE ASHBURN, TO BE USED BY THE ELECTRIC PLANT BOARD, d/b/a PADUCAH POWER SYSTEM, FOR THE LOCATION OF A POWER FEEDER LINE FROM NO. 5 SUBSTATION TO THE LONE OAK AREA OF McCRACKEN COUNTY WHEREAS, a parcel of land is owned of record by C. L. Ashburn and wife, Alice' Ashburn,. and is necessary for the location of a power feeder line from No. 5 Substation to the Lone Oak Area of McCracken County, and WHEREAS, the Electric Plant Board, d/b/a Paducah Power System, by resolution dated the 25th day of June, 1981, requested institution of condemnation proceedings in its behalf, and WHEREAS, it does not appear that a purchase agreement can be reached at this time with the owners of the subject property, and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, does therefore agree with the request of the Electric Plant Board, d/b/a Paducah Power System, that it will be necessary to institute condemnation pro- ceedings pursuant to Kentucky Revised Statutes to acquire an easement over this property. NOW, THEREFORE, BE IT ORDERED BY THE CITY OF PADUCAH , , KENTUCKY: SECTION 1. That the Corporation Counsel be, and he is hereby, ordered and directed to institute condemnation proceedings in McCracken Circuit Court against C. L. Ashburn and wife, Alice Ashburn, and any and all other parties in interest to acquire an easement over the subject property owned by the afore- mentioned. SECTION 2. That the parcel needed for an easement is more parti- cularly described as follows: A 10 foot wide strip of land along the rear of property presently owned by C. L. Ashburn and his wife, Alice Ashburn, which property fronts 88.1 feet on Nolan Drive and runs back in a northerly direction to the south right-of-way line of Interstate 24, and is wholly within the city limits of the City of Paducah. SECTION 3. This Order shall be in full force and effect from and after the date of its adoption.
