THE CONSTRUCTION_ OF_ A NEW WATER TREATMENT PLANT WHEREAS, a parcel of real estate is owned by Odell Giltner, et al, and is necessary for the construction of a. new water, I treatment plant, and WHEREAS, the Commissioners of Water Works,,. by .resolution dated the 29th day of December, 1980, requested. institution of condemnation.pro- ceedings in its behalf, and WHEREAS, it does not appear that a. purchase, agreement can be reached at this time with the owners of the subject property, and WHEREAS, the Board of Commissioners of the City of Paducah, Ken- tucky, does therefore agree with the request of the Commissioners of Water Works, that it will be necessary to institute condemnation proceedings pursuant to Kentucky Revised Statutes to acquire title to this property. KENTUCKY: NOW, THEREFORE, BE IT ORDERED BY THE CITY OF PADUCAH, SECTION 1,. That the Corporation Counsel be, and he is- hereby; ordered and. .directed to institute condemnation proceedings in McCracken Circuit Court against Odell Giltner, et al, and any and all other parties in interest to acquire all of the right, title and interest in the subject property owned by the aforementioned. SECTION 2. That the parcel to be taken is more particularly described as follows: Beginning at a point where the easterly line of the property pres- ently owned by the Jackson Purchase Lodge #15 of the F .O . P . , of record in Deed Book 488, Page 530 of the McCracken County Court Clerk's office, intersects the northerly right of way line of North 8th Street, said point of intersection being located 2120 feet, plus or minus, west of the point of intersection of the northerly right of way of North 8th Street with the east- erly right of way line of Ellis Street if extended in a northerly direction, said streets having rights of way widths of 60 feet and 50 feet, respectively; thence from the point of beginning, in a northerly direction and with the easterly line of the afore- said F.O.P. property 630.8 feet, plus or minus, to a point on the southerly right of way line of the Ohio River Flood Levee, said point being located 45 feet south of the center line of said levee at station 105+35, plus or minus, and being the northeast corner of the aforesaid F.O.P. property; thence in an easterly direction and with the southerly right of way line of said levee 135 feet, plus or minus, to station 104+00 of said levee; thence at a right angle, in a southerly direction and continuing with said levee right of way line 25 feet to a 43 44 point 70 feet left of station 104+00; . thence in an easterly direction and continuing with said levee right of way line, 70 feet south of the- center line- of said levee, 1,.187 feet,. plus or minus, to the northwest corner of the property presently owned by Paducah Broadcasters-, Inc . , as shown by .deed of record in Deed 'Book 589, Page' 771 of the aforesaid clerk's office, said point being .located at,_ levee station 92+13., plus or minus; thence leaving said levee, running in a southerly direction and with the westerly line of the aforesaid. Paducah Broadcasters, Inc., property 498 feet, plus or minus, to the northerly line of property presently owned by W. H.. Yancy and wife of record in Deed Book 428, Page 449, of the afore- said clerk's office, said point being located 175 feet west of Yancy's northeast corner; thence in a westerly direction and with Yancy's northerly line and the, northerly line of. others 1,335 feet, plus or minus, to the northwest corner of a tract of land presently owned , by , L . E. Tilford . and wife as shown by deed of record in Deed Book 554, page 697 of the aforesaid clerk's office; thence with Tilford's westerly _line, in _a . southerly direction 256 feet to the northerly right of way line of North 8th Street; thence in a westerly direction and with said northerly right of way line 20 feet, plus or minus, to the point of beginning; containing 13 acres, more or. less.. SECTION 3. This -Order shall be ,in full force and. effect-. from and after the date . of its adoption.
