MUNICIPAL ORDER No. 5
A MUNICIPAL ORDER RECITING THE NEED FOR ACQUIRING A CERTAIN
PARCEL OF LAND BELONGING TO LEROY CHAPPELL AND WIFE, ANGIE CHAPPELL,
TO BE USED FOR THE COMPLETION OF THE INTERIM COMMUNITY DEVELOPMENT PLAN
AND PROVIDING FOR AND AUTHORIZING THE CONDEMNATION OF SAME
WHEREAS, a parcel of real estate is owned of record by Leroy Chappell
and wife, Angie Chappell, and is necessary for the completion of the interim Com-
munity Development Plan, Application No. B-75HN-21-00009, and
WHEREAS, the Urban Renewal and Community Development Agency, by
resolution dated July 8, 1980, requested institution of condemnation proceedings in its
behalf, and
WHEREAS, it does not appear that a purchase agreement can be reached at
this time with the owners of the subject property, and
WHEREAS,
the
Board of Commissioners of the City
of Paducah, Kentucky,
does therefore agree
with
the request of the Urban Renewal
and Community Develop-
ment Agency
of the City of Paducah,
Kentucky, that it will
be necessary to institute
condemnation
proceedings pursuant to
the Kentucky Revised
Statutes to acquire
title to this property.
NOW, THEREFORE, BE IT ORDERED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Assistant Corporation Counsel be, and he is hereby,
ordered and directed to institute
condemnation
proceedings in the
McCracken Circuit
Court against Leroy Chappell and
wife, Angie
Chappell, and any
and all other parties
in interest to acquire all of the right, title and insterest in the subject property
owned by the aforementioned.
as follows:
SECTION 2. That the parcel to be taken is more particularly described
1. Beginning. ata stake on the. east side .of 10th Street -120 feet_
below Burnett Street; thence with 10th Street towards Flournoy
Street 40 feet; thence parallel with Burnett Street towards 9th
Street 150 feet to an alley; thence parallel with 10th Street to-
wards Burnett Street 40 feet; thence parallel with Burnett Street
150 feet to the beginning, and being part of Block No. 41 in
Harris, Flournoy, Trimble and Norton's Addition to Paducah,
Kentucky.
II. Beginning at a stake on the east side of 10th Street 110 feet
below Burnett Street; thence parallel with Burnett Street toward
9th Street 150 feet to an alley; thence with said alley and towards
Flournoy Street 10 feet; thence parallel with Burnett Street 150
feet to 10th Street; thence with 10th Street to the beginning 10 feet.
