HomeMy WebLinkAboutMO # 156259 MUNICIPAL ORDER NO. 156 A MUNICIPAL ORDER AUTHORZING-THE CITY OF PADUCAH TO DEFEND JOHN PENROD, ROBERT COLEMAN HAROLD FORD, JOE VITERISI AND JAMES FLYNN IN A SUIT FILED BY PAUL MOORE WHEREAS, Paul Moore, a employee of the City of Paducah who was furloughed on May 17, 1983, filed suit against the City in United States District Court for the Western District of Kentucky in 1981, alleging a violation of -his rights provided under Section 42 U.S.C. the City of Paducah and one Robert Green, and WHEREAS, said plaintiff, Paul Moore, has amended his -complaint in United States Dis- trict Court for the Western District of Kentucky, naming the Mayor, John Penrod and the Com- missioners, Robert Coleman, Harold Ford, Joe Viterisi and James Flynn as individual defendants i his cause of action, and WHEREAS, said lawsuit is filed against the John Penrod, Robert Coleman, Harold Ford, Joe Viterisi and James Flynn, individually, as a result of their actions as members of the Board of Commissioners of the City of Paducah, and the Board of Commissioners of the City of Paducah finds that any actions t by John Penrod, Robert Coleman, Harold Ford, Joe Viterisi and James Flynn was -in the best in- terest of the City of Paducah in furtherance of their official duties as members of the Board of Commissioners of the City of Paducah. BE IT ORDERED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH AS FOLLOWS: That the City of Paducah shall provide John Penrod, Robert Coleman, Harold Ford, Joe Viterisi and James Flynn, individually, with legal representation and defenses in the suit filed by Paul Moore against them individually in the United States District Court for the Western District of Kentucky. That the Corporation Counsel is hereby instructed to defend John Penrod, Robert Coleman, Harold Ford, Joe Viterisi and James Flynn, individually, in said suit. SECTION 3. If it would appear that a conflict of interest exist between the defense o the City of Paducah and the defense of John Penrod, Robert Coleman, Harold Ford, Joe Viterisi an James Flynn, the Corporation Counsel is instructed to secure outside attorneys for the defense o John Penrod, Robert Coleman, Harold Ford, Joe Viterisi and James Flynn. Any attorney so employe would be subject to the approval of John Penrod, Robert Coleman, Harold Ford, Joe Viterisi and James Flynn. This Order shall be effective upon its passage according to law.
