HomeMy WebLinkAboutMO # 376589 MUNICIPAL ORDER NO. 376 A MUNICIPAL ORDER ESTABLISHING POLICY WITHIN THE CITY OF PADUCAH CONTROLLING CERTAIN ACTIVITIES OF THE STREET DEPARTMENT WHEREAS, the Street Department of the City of Paducah performs various services which affect individual members of the public; and WHEREAS, the Board of Commissioners deems it necessary to clarify the position of the City as to services which will be offered by the City. BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. Curb, Gutter and Sidewalk Replacement. The City of Paducah shall replace or repair curbs, gutters and sidewalks under the following conditions: (a) The adjoining property owner shall be responsible for the purchase of con- crete to replace curbs, gutters and sidewalks which are repaired by the City of Paducah, whether such replacement is because of the dangerous condition of the sidewalk or because of general deterioration. The director of the Street Department shall be the sole judge as to which sidewalks are in need of replacement and repair. (b) When circumstances are such, in the opinion of the director of the Street Department, that the curb, gutter and/or sidewalk constitute an immediate safety hazard, the City shall repair the curb, gutter and/or sidewalk at its own cost. (c) When any property is redeveloped it shall be the sole responsibility of the redeveloper to replace curbs, gutters and/or sidewalks at its own cost. (d) The property owner is responsible for the construction of drive aprons in total. The City will not share in this cost. However, in situations where the setback of the sidewalk is more than 10 feet from the curb, the City may elect to make a continuous walk based on the evaluation of the Street Department director. SECTION 2. Sewer Maintenance. Whenever a sewer blockage occurs at or near an individual residence or, commercial business, the City shall check the main sewer line to determine whether a blockage has occurred in that main. If it is found that the main is not blocked, it shall be the sole responsibility of the adjoining property owner to clean the service lateral line all the way to the main, including any portion of the lateral service line which may run under the City right-of-way. The City shall be responsible for cleaning or clearing any blockage that occurs in the main. SECTION 3. Street Shoulders. The City shall not maintain any areas along the sides of any improved streets that are being used by adjoining residents as a parking area, nor shall the City furnish gravel or any other type of fill, or keep these areas graded. However, if, in the opinion of the director of the Street Department, any of these areas cause a blockage and prevent proper drainage, the City will perform whatever work is necessary to maintain proper drainage. SECTION 4. Maintenance of -Driveway Entrances. The City will install new pipe in open drainage ditches on a one-time basis when a driveway is first installed to a lot. The property owner shall be responsible for supplying the pipe that meets the specifications set forth by the director of the Street Department. The City shall install said pipe to grade and cover with red gravel. The City shall not provide any further covering of any type, nor will it supply any gravel after initial installation of the pipe. There will be a limit of one driveway per property owner. 590 SECTION 5. Storm Damage. The City will pick up all trees, limbs, etc., from City streets, alleys, right- of-ways, etc., after a storm. Additionally, the City will pick up trees, limbs. etc., on A private property, which are damaged as a result of a storm, provided they are cut to a reason- able size and placed along the right-of-way by the residence. SECTION 6. Tree Limbs - Trimmings. The City will pick up and dispose of tree trimmings, shrubbery clippings, lawn clippings, and other types of trash from personal residences if said trimmings, etc., are in a reasonable amount and placed in an area easily accessible to the City crews. The director of the Street Department shall be the sole judge in determining what constitutes a reasonable amount of clippings and the availability of City work crews for this purpose. SECTION 7. Christmas Trees. The Street Department will pick up Christmas trees on a zone -by -zone basis in late December and early January. The director of the Street Department will set forth the schedule for this pick-up. Christmas trees will not be picked up by the City at any other times. SECTION 8. During leaf season (normally November through January) leaves may be placed at the curb or lawn edge and will be picked up on a zone -by -zone basis by the Street Department, with leaf machines. At all other times of the year leaves may not be placed, loose, in the' curb or along the right-of-way, and must be bagged. Leaves that are bagged will be picked up by the Street Department, upon request by the property owner. Scheduling this type of work shall be at the sole discretion of the director of the Street Department. SECTION 9. This order supersedes and replaces any orders previously adopted that are in conflict with provisions of this Municipal Order. SECTION 10. This order shall be in full force and effect from and after the date of its adoption.
