LLi vii ~ ~... _ i~ ~ _. ~!_ r~i -i~._.~~ I ..I _.._~.. ~.J..muu~-id..iu al~.l~~l~u:.~., ~~,' 434 MUNICIPAL ORDER NO. 591 A MUNICIPAL ORDER AUTHORIZING THE MAYOR TO EXECUTE A SEWER AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY, AND THEODORE HERPEL AND HIS WIFE, MARY AGNES HERPEL, AND HERPEL ENTERPRISES, INC. WHEREAS, Herpel is desirous of developing a 40-acre tract of real property located in McCracken County, ~ Kentucky known to as Stinespring Estates Subdivision; and .~,.. WHEREAS, to develop Stinespring Estates Subdivision, it is necessary for Herpel to obtain sanitation sewage services to service the residential lots to be located therein; and WHEREAS, Herpel has requested that the City provide such sanitation on sewage services for Stinespring Estates Subdivision; and '~ ~ WHEREAS, pursuant to ordinance, Herpel may only _ obtain City sanitation sewage services if and only if Stinespring Estates Subdivision is annexed to the City so as to become a part thereof; and WHEREAS, the City is agreeable to providing such sanitation services to Stinespring Estates subdivision, provided that the City annex Stinespring Estates Subdivision, and additionally, that Herpel agree to the terms and provisions set forth in the Agreement, all of which conditions are acceptable to Herpel. ' BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The Mayor is authorized to execute a Sewer Agreement between the City of Paducah and Theodore Herpel and his wife, Mary Agnes Herpel, who are residents of McCracken County, Kentucky, and Herpel Enterprises., Inc., a Kentucky Corporation. This Agreement is attached hereto and incorporated by reference as if fully set out herein. SECTION 2. This Order will be in full force and effect from and after the date of its adoption. GERRY B.
