A MUNICIPAL ORDER APPROVING THE FINAL REPORT OF
THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED
SUBDIVISION OF PROPERTY OF PHILIP HIGDON FOR JULIANNE HEIGHTS
LOCATED ON MINNICH AVENUE, ACCEPTING DEDICATION OF PUBLIC
EASEMENTS AND A LETTER OF CREDIT IN THE AMOUNT OF $16,000
WHEREAS, the Paducah Planning Commission, at a
meeting held on July 18, 1994, adopted as a preliminary report
a plat of the proposed subdivision of property of Julianne
Heights, and by Resolution dated February 6, 1995, recommended
to the Board of Commissioners of the City of Paducah, Kentucky,
the adoption of an order approving the final plat of said
subdivision reflected thereon, and accepting the dedication of
easements shown thereon; and
WHEREAS, the City Engineer has recommended a
letter of credit in the amount of $16,000 for construction of
sanitary sewers, and other designated public improvements.
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution adopted by the Paducah
Planning Commission on February 6, 1995, entitled, "A
RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH
PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY OF
C PHILIP HIGDON FOR JULIANNE HEIGHTS LOCATED ON MINNICH AVENUE",
be approved as the final report of said Commission respecting
the matters set forth therein.
SECTION 2. That the dedication of the public
easements and construction of sanitary sewers shown on said
plat shall be, and they are hereby, accepted, but such
acceptance shall not constitute an undertaking on the part of
this Board or the City of Paducah, Kentucky, for the
construction, improving or maintaining of said right-of-way,
that being a matter for separate consideration and action. The
Mayor is hereby authorized to subscribe a certificate of
approval on the plat.
SECTION 3. That a letter of credit in lieu of a bond
in the amount of $16,000.00, is set, and is in favor of the
City of Paducah, and shall be in such form and containing such
contents that meet the approval of the City Engineer and the
�. Corporation Counsel of the City of Paducah.
SECTION 4. That if any section, paragraph or
provision of this municipal order shall be found to be
inoperative, ineffective or invalid for any cause, the
deficiency or invalidity of such section, paragraph or
provision shall not affect any other section, paragraph or
provision hereof, it being the purpose and intent of this
municipal order to make each and every section, paragraph and
provision hereof separable from all other sections, paragraphs
and provisions.
SECTION 5. This order shall be in full force from
and after the date of its adoption.
