A MUNICIPAL ORDER ADOPTING A RESOLUTION ENTITLED, "RESOLUTION OF THE COMMISSIONERS OF WATERWORKS OF THE CITY OF PADUCAH DECLARING REAL AND PERSONAL PROPERTY ON GLENWOOD DRIVE SURPLUS PROPERTY; REQUESTING THE BOARD OF COMMISSIONERS ( Z", OF THE CITY AUTHORIZE SALE OF SAID PROPERTY AND DISTRIBUTION OF PROCEEDS; AND AUTHORIZING AND DIRECTING ADVERTISEMENT OF SAID PROPERTY FOR SALE" WHEREAS, the Commissioners of Water Works have declared the real and personal property on Glenwood Drive is no longer suitable or necessary to the operation of the Water Works; and WHEREAS, the Commissioners of Water Works have declared this to be surplus property; and WHEREAS, the Commissioners of Water Works have declared the proceeds form the sale of this property are needed to continue the efficiency operation of the Water Works, and that it would be in the best public interest to sell same; and WHEREAS, said property is presently owned by the City of Paducah, Kentucky. BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY: �i SECTION 1. That the City of Paducah hereby authorizes the Commissioners of Water Works to sell the aforesaid real and personal property, more particularly described as follows: Being a tract of land located on the easterly side of Glenwood Drive, south of Elmdale Road and adjacent to the Forest Hills Public Housing Development in the City of Paducah, McCracken County, Kentucky, said tract of land being more particularly described as follows: Beginning at a 4" x 4" concrete monument found where the easterly right-of-way line of Glenwood Drive intersects the southerly line of Block 19 of the Forest Hills Public Housing Development as shown by plat of said development of record in Plat Section "E", page 4, of the McCracken County Court Clerk's Office, said concrete monument being located S. 04°- 56'-20" W. a distance of 130.08 feet from another 4" x 4" concrete monument found at the intersection of the easterly right-of-way line of said Glenwood Drive with the southerly right-of-way line ofElmdale Road; thence S. 84°-15'-26" E. ( along and with the southerly line of the aforesaid Block 19, a distance of 289.19 feet to a 4" x 4" concrete monument found on the westerly right-of-way line of Farwood Drive at the south end of the dedicated right-of-way; thence S. 84°-15'-26" E. crossing the end of said right-of-way, 50.00 feet to the easterly line thereof at the southwesterly corner of Block 15 of the aforesaid development; thence S. 84°-15'-26" E. along and with the southerly line of said Block 15, a distance of 133.20 feet to a'/2" steel rod set at the southeasterly corner of said block; thence S. 03°-45'-50" W. along and with a projection of the - 402 403 easterly line of said Block 15, a distance of 535.38 feet to a 4" x 4" concrete monument found on the northerly line of a tract of land formerly owned by Pilley and Haralson; thence N. 86°-15'- 07" W. along and with said northerly line, 476.05 feet to a 1/z" steel rod set at a point bearing S. 86°-15'-07" E. a distance of 93.69 feet from a 4" x 4" concrete monument found at the easterly most corner of a tract of land owned by Paducah Newspapers, Inc., and described as Tract No. H in Deed Book 703, Page 492, of the aforesaid Clerk's office; thence leaving said northerly line, N. 40°-36'-52" W., along and with a new line as established herein, 152.14 feet to a 1/2" steel rod set at the beginning of a curve that is concave to the east; thence along and with the arc of said curve having a 20.00 foot radius, a chord length of 26.37 feet and a bearing on the chord of N. 00°-37'-30" E., a distance of 28.79 feet to a 1/2" steel rod set on the easterly right-of-way line of Glenwood Drive, 25 feet east of the center line thereof, thence along and with said easterly right-of-way line and the arc of a curve that is concave to the west having a radius of 514.80 feet, a chord length of 326.19 feet and a bearing on the chord of N. 23°-23'-39" E., a distance of 331.91 feet to a 4" x 4" concrete monument found at the end of said curve; thence N. 04°-55'-26" E. continuing with said right-of-way line, 109.54 feet to the point and place of beginning. The aforesaid property contains 277,705 square feet or 6.375 acres. The bearings in this description are based upon a bearing of N. 04°-55'-26" E. along the easterly right-of-way line of Glenwood Drive as stated on the aforesaid plat of record in Plat Section "E", page 4. See Waiver of Subdivision Plat of record in Plat Book "J", page 1471, in the office of the Clerk of the County Court of McCracken County, Kentucky. Being a part of the same property conveyed to Henry J. Soenneker, Bishop of the Diocese of Owensboro by deed dated August 21, 1965 and recorded in Deed Book 472, page 293, in the office of the Clerk of the County Court of McCracken County, Kentucky. SECTION 2. The City of Paducah hereby authorizes the Corporation Counsel to approve, and the Mayor and City Clerk to execute, the deeds of conveyance necessary to effectuate the sale of the aforesaid real and personal property, and further authorizes the proceeds from this sale to be deposited in the General Fund Account of Paducah Water Works. SECTION 3. This Order will be in full force and effect from and after the date of its adoption.
