MUNICIPAL ORDER NO. 9150
A MUNICIPAL ORDER ESTABLISHING
STREET MUSIC COORDINATORS
WHEREAS, the City Commission wishes to encourage performances by
street musicians to enhance the festive atmosphere of community events; and
-� WHEREAS, coordination in the use of City sidewalks and streets is required
to assure that performances by street musicians do not conflict with each other or the
public;
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The City Manager is authorized to appoint citizen volunteers
who may assist the City as Street Music Coordinators in the following manner:
A. Each Street Music Coordinator will be appointed for specific
community festivals or events and for specific geographic areas, as the
City Manager may designate.
B. Within his or her assigned time and area the Street Music Coordinator
has authority to:
➢ Recruit musicians but not to obligate the City for the payment
of any performance.
➢ Assign individual musicians or groups to specific performance
locations on public property, sidewalks, or the closed travel -
ways of public streets.
➢ Assign individual musicians or groups to specific performance
times at their assigned location.
➢ Prescribe how the assigned performance space shall be used so
as to prevent dangerous blocking of pedestrian traffic. (In any
matter regarding public safety, the decision of a Police Officer
will pre-empt the decision of a Street Music Coordinator)
➢ Restrict amplification levels so that the volume from one
performance does not disrupt the ability to hear an adjacent
performance.
C. In recruiting musicians and assigning performance locations a Street
Music Coordinator should:
➢ Give first priority to public safety, but must subordinate his
decision to the decision of a Police Officer
➢ Provide a variety of music styles
➢ Rotate preferred sites among participating musicians
➢ Place musicians who draw large crowds at sites that can safely
accommodate the crowd
➢ Accommodate whenever possible the preferences of adjacent
business operators.
➢ Provide opportunities for young musicians and new musicians
to perform

D. Musicians performing on private property within the Street Music
Coordinator's designated area may choose to voluntarily place
themselves under the direction of a Street Music Coordinator in the
same manner as musicians performing on public property; provided,
however, a Street Music Coordinator may not infringe on the rights of
the private property owner.
Musicians performing on private property who choose not to come
under the direction of the Street Music Coordinator are required limit
the volume of their music to a level which allows individuals speaking1
in a normal conversational tone 100 feet from the nearest point where
the public right-of-way touches the private property where the music is
being paid to clearly hear each other.
E. The Police Department will coordinate with Street Music Coordinator
in enforcing the terms of this Municipal Order including, but not
limited to, the enforcement of City ordinances pertaining to traffic and
pedestrian safety, sidewalk obstructions and noise control, as the
Police Officer believes necessary.
F. Individuals who feel they have been aggrieved by a decision of a
Street Music Coordinator may appeal their grievance to the City
Manager. Any such grievance shall be in writing, shall state the action
being grieved, and shall propose a remedy. A decision by the City
Manager shall be final.
G. Street Music Coordinators are also authorized to coordinate and
encourage participation and performances by mimes, magicians,
jugglers, and similar street performers in the same manner as set forth
above.
H. The City Manager may revoke any designation as Street Music
Coordinator at any time at his sole discretion.
SECTION 2. This Order shall be in full force and effect on and after the date
of its adoption.
