At a Regular Meeting of the Board of Commissioners, held on Tuesday, October 21,
2008, at 5:30 p.m., Mayor Paxton presided, and upon call of the roll by the City Clerk,
the following answered to their names: Commissioners Coleman, Kaler, Smith, Watkins
and Mayor Paxton (5).
PROCLAMATION
SAFE SCHOOL WEEK
Mayor Paxton presented a proclamation to Wayne Waldon, Public Relations Officer for
the Paducah Independent Schools, proclaiming October 19, 2008 through October 25,
Il 2008, as "Safe School Week".
PRESENTATIONS
YEISER ART CENTER
Connie Johnson, Chairperson of Yeiser Art Center; Bob Bloomingburg, Treasurer and
Terri Moore, Executive Director were present to discuss the Yeiser Art Center and how
important it is to the community. Last year, the Yeiser celebrated their "50th
Anniversary. It is the heart of the art community. At this time they are in the middle of a
board membership campaign. Expenses have been cut approximately $20,000 over the
last couple of years but a budget of at least $60,000 is still necessary. They believe they
will be able to raise $40,000 to $45,000 and are requesting the City help with funding of
the shortfall.
DUDLEY COURT
Steve Kyle, Acting Fire Chief, has volunteered to chair a staff task force to help with the
situation at Dudley Court Apartments located at 801 McGuire Street. About 1 to 2
months ago the Fire and Inspection Departments were notified of gas leaks at the
apartment complex. Upon inspection, several systemic problems were found. This led
to all of the gas furnaces being shut off due to non-compliance of the NFPA Fuel Gas
Code and International Mechanical Code. This also includes cook stoves and the gas
water heaters. At this time, all of the gas water heaters have been repaired but the owner
has notified the City that all funds have been depleted. The owner is trying to obtain
additional funds through financing. The City has sent a letter to the owner stating they
will have to provide heat for the residents or they will have to be moved. Once the letter
is received, the owner will have 21 days for repairs to be completed and the City has
stated that there will be no extensions of time. Section 8 and Paducah Housing Authority
will be able to assist in the transition of tenants to other housing facilities. The main
concern of the City is the safety of the residents. Mr. Kyle will continue to update the
Board and the public as the situation proceeds.
WORKSHOP
POLICE AND FIREFIGHTER PENSION FUND ACTUARIAL REPORT
Jon Perkins, Finance Director, introduced Kevin Sullivan of Bryan, Pendleton, Swats &
McAllister, LLC. Mr. Sullivan gave a summary of the "Review of Actuarial Valuation as
of July 1, 2008" for the City of Paducah Police and Firefighters' Pension Fund. With the
downturn in the economy, the fund's assets are much lower than projected. The fund is
at a point where there is not enough money for cost of living raises for the recipients.
Plus, the City will have to contribute more to keep the fund from.having an unfunded
liability. The actuary's report calls for minimum funding of $226,057 for FY2009. The
FY2009 budget already contains $12,890 so an additional $213,167 would be needed to
meet the City's minimum obligation for the current year.
Mayor suggested Mr. Sullivan come back to the Commission before the budgeting
process to give an idea of the amount the City will have to pay for FY2009-2010.
JSA REPORT
John Hodges, Executive Director of the Paducah McCracken Joint Sewer Agency (JSA),
briefed the Commission on the activities of JSA and went over an informational flyer that
will be provided to residents. JSA is responsible for the operation and maintenance of
Paducah and McCracken County's wastewater collection and treatment system. In
September 2007, JSA entered into a Consent Judgment with the State and has received an
Administrative Order from the Environmental Protection Agency to address overflows
and outfalls to improve its collection systems. During a storm, flow in a sewer system

may exceed the pipe's capacity. When this occurs, untreated wastewater may flow into
streams and rivers. JSA is permitted for these discharges; however, the Judgment and
Order require JSA to develop and implement plans to reduce the discharges and improve
the sewer system. JSA is not alone; other communities in Kentucky are under similar
consent judgments. A sewer system may overflow due to pipe failures, blockages, or
maintenance issues. Since July 2005, JSA has spent more than $7 million on
maintenance and rehabilitation.

ACCEPT BID FOR CONVENTION CENTER RENOVATIONS
Commissioner Kaler offered motion, seconded by Commissioner Coleman, that the
Board of Commissioners introduce and adopt an ordinance entitled, "AN ORDINANCE
ACCEPTING THE BID OF D S CONTRACTORS, INC. FOR THE FACILITY
RENOVATION -PHASE I OF THE JULIAN CARROLL CONVENTION CENTER
PROJECT, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR
SAME." This ordinance is summarized as follows: This ordinance is summarized as
follows: That the City of Paducah accepts the bid of D S Contractors In., in am amount
not to exceed $198,938.00, for the Facility Renovation -Phase I of the Julian Carroll
Convention Center project, and authorizes the Mayor to execute a contract for same.

Commissioner Smith offered motion, seconded by Commissioner Watkins, that the Board
of Commissioners introduce an ordinance entitled, "AN ORDINANCE ACCEPTING
THE BID OF LARRY SMITH CONTRACTORS, INC., FOR THE FLOODWALL PIPE
REHABILITATION PROJECT, AND AUTHORIZING THE MAYOR TO EXECUTE
A CONTRACT AND ALL DOCUMENTS NECESSARY FOR SAME." This ordinance
is summarized as follows: That the City of Paducah accepts the bid of Larry Smith �Q
Contractors, Inc., in the amount of $1,764,605.28, for the floodwall pipe rehabilitation
project, and authorizes the Mayor to execute a contract and all documents necessary for
same.
CITY MANAGER REPORT
• Personnel Actions
Mr. Zumwalt commended the Parks Services staff for their response in the
handling of the MRSA situation. An employee discovered he/she had the MRSA
infection and the employee had been in contact with several of the participants in

the City's parks programs. The Parks Department handled the situation quickly
and notified all families immediately.
