That the City of Paducah, Kentucky, hereby approves the purchase of real property in the amount of $10,000, from Michael Shelton Tapscott and wife, Lisa Tapscott located along Perkins Creek and adjacent to Stuart Nelson Park, situated in Paducah, McCracken County, Kentucky, and more particularly described as follows: BEING A TRACT OF LAND LOCATED ADJACENT AND CONTIGUOUS TO THE NORTHERLY BOUNDARY LINES OF THE BLUEGRASS DOWNS RACE TRACK NEAR THE CORPORATE LIMITS OF THE CITY OF PADUCAH, MCCRACKEN COUNTY, KENTUCKY, SAID PROPERTY BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A STEEL ROD, ONE-HALF INCH IN DIAMETER, TWENTY FOUR INCHES LONG, WITH A YELLOW PLASTIC CAP STAMPED "FMT ENGRS KYLS 1842" (HEREINAFTER REFERRED TO AS A STEEL ROD AND CAP) SET WHERE THE EASTERLY LINE OF THE PROPERTY DESCRIBED IN DEED BOOK 282, PAGE 34 OF THE MCCRACKEN COUNTY COURT CLERK'S OFFICE INTERSECTS THE NORTHERLY LINE OF THE PROPERTY DESCRIBED IN DEED BOOK 801, PAGE 411 OF SAID CLERK'S OFFICE, SAID MARKER BEING LOCATED S.5940'47"E. A DISTANCE OF 1,156.00 FEET AND N.1349'l3"E. A DISTANCE OF 41.72 FEET FROM A ONE-HALF INCH DIAMETER STEEL ROD FOUND AT THE SOUTHWESTERLY CORNER OF THE PROPERTY DESCRIBED IN DEED BOOK 282, PAGE 113 OF SAID CLERK'S OFFICE; THENCE FROM SAID POINT OF BEGINN�G PROCEED N.1349'13"E. ALONG AND WITH THE AFORESAID EASTERLY LINE OF SAID PROPERTY OF RECORD, 182.52 FEET TO A STEEL ROD AND CAP SET AT A POINT THAT IS 175.00 FEET NORTH OF AND PERPENDICULAR TO THE NORTHERLY LINE OF SAID PROPERTY DESCRIBED IN SAID DEED BOOK 801, PAGE 411; THENCE PROCEED 5.5940'47"E. ALONG AND WITH BAUMER'S WESTERLY LINE 179.95 FEET TO A STEEL ROD AND CAP SET ON THE NORTHERLY LINE OF THE PROPERTY AFORESAID IN DEED BOOK 801, PAGE 411, SAID MARKER BEARS N.6324'1 1"W, 27.31 FEET FROM ANOTHER STEEL ROD AND CAP SET ON SAID NORTHERLY LINE; THENCE PROCEED N.6324'11"W. CONTINUING WITH THE AFORESAID NORTHERLY LINE, 66.99 FEET TO ANOTHER STEEL ROD AND CAP SET ON SAID LINE; THENCE PROCEED N.5940'47"W. CONTINUING WITH SAID NORTHERLY LINE 19.06 FEET TO A STEEL ROD AND CAP SET ON SAID LINE; THENCE PROCEED N.5940'47"W. CONTINUING WITH SAID NORTHERLY LINE 484.87 FEET TO THE POINT OF BEGINNING. THE AFORESAID PROPERTY CONTAINS 99,405 SQUARE FEET OR 2.282 ACRES. THE BEARINGS CITED IN THIS DESCRIPTION ARE BASED ON BEARINGS SHOWN ON AN UNRECORDED PLAT OF SURVEY MADE BY OTHERS OF THE PROPOSED PADUCAH DOWNS PROPERTY. 690 BEING A PORTION OF THE SAME PROPERTY CONVEYED TO MICHAEL SHELTON TAPSCOTT BY DEED DATED APRIL 25, 1997, OF RECORD IN DEED BOOK 872, PAGE 157, AND BY DEED DATED OCTOBER 31, 1994, OF RECORD IN DEED BOOK 821, PAGE 285, MCCRACKEN COUNTY COURT CLERK'S OFFICE. SEE DEED OF CORRECTION DATED NOVEMBER 8, 2001, OF RECORD IN DEED BOOK 968, PAGE 536, WHEREIN THE PROPERTY WAS VESTED IN MICHAEL SHELTON TAPSCOTT AND WIFE, LISA TAPSCOTT. THIS DESCRIPTION WAS DRAFTED BY RICHARD G. DAVIS, KENTUCKY PROFESSIONAL LAND SURVEYOR #1842, OF THE FIRM OF FARRIS, MCINTOSH AND TREMPER, INC., 124 SOUTH 31 ST STREET, PADUCAH, KENTUCKY 42001, FROM A BOUNDARY LINE SURVEY AND PLAT OF THE SUBJECT PROPERTY COMPLETED ON AUGUST 26, 2004. SECTION 2. The Mayor is hereby authorized to execute a deed for the purchase of real property located along Perkins Creek and adjacent to Stuart Nelson Park and being more particularly described in Section 1 above.
