MUNICIPAL ORDER NO. 1120
A MUNICIPAL ORDER AUTHORIZING THE MAYOR TO ENTER
INTO AN ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH
AND EASTER SEALS WEST KENTUCKY FOR AN ENCROACHMENT UPON A
PORTION OF CITY OF PADUCAH RIGHT-OF-WAY AT THE INTERSECTION OF
29TH STREET AND LaCLEDE AVENUE
WHEREAS, Easter Seals West Kentucky is the owner of property located
at 801 North 29th Street, situated in McCracken County, Paducah, Kentucky; and
WHEREAS, the City of Paducah is the owner of a portion of 29th Street
and LaClede Avenue located adjacent to 801 North 29th Street, situated in McCracken
County, Paducah, Kentucky; and
WHEREAS, Easter Seals West Kentucky is desirous of encroaching upon
and utilizing a portion of the right of way at the intersection of 29th Street and LaClede
Avenue located adjacent to 801 North 29th Street for the installation of a sign; and
WHEREAS, the City is desirous of permitting the aforesaid encroachment
by Easter Seals West Kentucky; and
WHEREAS, the City of Paducah and Easter Seals West Kentucky have
now entered into an agreement pertaining to the foregoing and do desire that same be set
forth in writing and be made part of the public records of the City of Paducah, Kentucky,
and recorded in the office of the County Court Clerk of McCracken County, Kentucky.
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized to enter into an
Encroachment Agreement with Easter Seals West Kentucky for a sign (8' X 4') to be
located upon a portion of City of Paducah right-of-way approximately 20' within the
right of way of the intersection of 29th Street and LaClede Avenue, and also be located
adjacent to the Easter Seal's property located at 801 North 29th Street.
SECTION 2. This order shall be in full force and effect from and after the
date of its adoption.
