MUNICIPAL ORDER AUTHORIZING AN AGREEMENT
WITH PADUCAH SHEET METAL WITH REGARD TO
PAYMENT OF LICENSE FEES
WHEREAS, through error of the City in defining Paducah Sheet Metal as a
new business in an enterprise zone, the City did not require nor make demand upon
Paducah Sheet Metal to pay license fees for the years 2000 through 2003; and
WHEREAS, Paducah Sheet Metal was in fact an existing business which
located in the enterprise zone, and as such, was required to pay license fees on an annual
basis; and
WHEREAS, by reason of being an existing business, Paducah Sheet Metal
was required to pay license fees for said years in the amount of $24,096.00; and
WHEREAS, it is the desire of the City Commission that an agreement be
made with Paducah Sheet Metal with regard to the payment of license fees for the years
2000 through 2002 in the amount of $24,096.00, but that penalty and interest be waived
with regard to same.
IT IS HEREBY ORDERED AS FOLLOWS:
SECTION 1. The City Manager is hereby authorized to execute an agreement
in behalf of the City with Paducah Sheet Metal with regard to the payment by Paducah
Sheet Metal of license fees due the City in the amount of $24,096.00 for the years 2000
through 2002. The terms of such agreement shall be those terms as determined by the
City Manager.
SECTION 2. Because of the error committed by the City, the City
Commission does hereby waive any claim for penalty and interest on the license fees to
be paid by Paducah Sheet Metal.
SECTION 3: This Order shall be in full force and
of its adoption.
