A MUNICIPAL ORDER RATIFYING AND APPROVING THE
MAYOR'S EXECUTION OF AN EASEMENT AGREEMENT BETWEEN JIM SMITH
CONTRACTING COMPANY, LLC, THE CITY OF PADUCAH, AND THE
ELECTRIC PLANT BOARD OF THE CITY OF PADUCAH, D/B/A PADUCAH
POWER SYSTEM FOR AN EASEMENT UPON A PORTION OF PROPERTY

AN ELECTRIC DISTRIBUTION TRANSFORMER AND APPROVING SAID
EASEMENT AGREEMENT
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby ratifies and approves the
Mayor's execution of an Easement Agreement between Jim Smith Contracting Company,
LLC, the City of Paducah, and the Electric Plant Board of the City of Paducah, d/b/a
Paducah Power System for a perpetual easement upon a portion of property along
Jefferson Street adjacent to the Floodwall for installation, operation, and maintenance of
an electric distribution transformer.
SECTION 2. That the City hereby approves the Easement Agreement
referred to in Section 1 above and that the perpetual easement conveyed in said agreement
r* is more particularly described as follows:
Being property located on the northern side of Jefferson Street,
northwest of the intersection with North Water Street, City of Paducah,
McCracken County, Kentucky, being a portion Lot 1, Block 1, of Addition
"D" to the City of Paducah and being a part of the lands as described in
Deed -Book 846, Page 619 of the records of the McCracken County Court
Clerk, said easement being more particularly described as follows:
Commencing at the southeast corner of Lot 1, Block 1, of
Addition to the City of Paducah;
Thence, along the northern right-of-way line of Jefferson Street
(located 33' from the centerline thereof) and the south line of said
Lot 1, South 64°59'26" West, a distance of 16.33 feet to a point,
this being the point of beginning;
Thence, continuing along said northern right-of-way line of Jefferson
Street and the south line of said Lot 1, South 64°59'26" West, a
distance of 40.23 feet to a point;
Thence, along a new easement line, North 25°02'35" West, a
distance of 20.00 feet to a point;
Thence, along another new easement line, North 64°59'26" East, a
distance of 31.09 feet to a point in the southwesterly line of the
City of Paducah property as described and recorded in Deed Book
200, Page 250 of the McCracken County Court Clerk;
Thence, with said City of Paducah property, South 49°35'23" East, 21.99
feet back to the point of beginning.

The above-described easement contains 713 sq. ft. more or less.
All bearings referred to are based on the Kentucky State Plane South Zone
(NAD 1983).
Prepared by and in accordance with fieldwork performed under the
supervision of Gerald M. Kight, Ky. Licensed Prof Surveyor 2547,
Florence & Hutcheson, Inc., 2550 Irvin Cobb Drive, Paducah, Ky.
42003.
Being in all respects a part of the same property conveyed to Jim Smith
Contracting, Inc. a Kentucky corporation, by deed dated February 28,
1996, and recorded in Deed Book 846, page 619, McCracken County
Clerk's Office, and subject to an unrecorded lease agreement granted in
favor of the City of Paducah, Kentucky. Jim Smith Contracting Company,
LLC, is a manager -managed Kentucky limited liability company,
the operating agreement of which authorizes its president, Calvin Rex
Smith, to act on behalf of the managers to bind the limited liability
company.
This easement agreement was prepared by the draftsman
without the benefit of a title examination. The draftsman assumes
no liability for the accuracy of the legal description herein.
SECTION 3. This Order will be in full force and effect from and after the
date of its adoption.
