HomeMy WebLinkAboutMO # 1284705 MUNICIPAL ORDER NO. 1284 A MUNICIPAL ORDER ACCEPTING THE DONATION OF REAL PROPERTY LOCATED IN STARLITE PLAZA SUBDIVISION, PHASE II, TO THE CITY OF PADUCAH AND AUTHORIZING THE MAYOR TO EXECUTE A DEED OF CONVEYANCE FOR SAME BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The City of Paducah hereby accepts the donation of real property located in Starlite Plaza Subdivision, Phase II, Lot 8, owned by Max L. Edwards and wife, Lois Ann Edwards; Sterling D. Edwards and wife, Ondria Kay Edwards; Lake F. Edwards and wife, Randa Edwards; and Wanda T. Smith and husband, Robert Smith. This property is located adjacent to the City of Paducah's Floodwall and will be utilized as a stormwater holding area and a direct stormwater drainage outlet to the Tennessee River. SECTION 2. That the property authorized in Section 1 above, heretofore approved for acceptance, is more particularly described as follows: A certain tract of land as surveyed by Ricky A. Tosh, PLS 2900 of the firm Dummer Surveying & Engineering Services, Inc. in Paducah Kentucky on April 07, 2006. Located north of Starlite Drive and east of Wayne Sullivan Drive, Paducah, McCracken County, Kentucky, being Lot 8 of Starlite Plaza Subdivision Phase II as recorded in Plat Section "L", Page 1769, and being more particularly described as follows: Commencing at a 1/2" diameter x 24" long rebar with plastic cap stamped "R. TOSH KYPLS 2900" (set) in concrete 25.00 feet north at right angles from the centerline of Starlite Drive, said centerline point being located 384.76 feet east of the centerline intersection of Starlite Drive and Wayne Sullivan Drive; THENCE from the commencing point North 11 degrees 12 minutes 06 seconds East for a distance of 590.31 feet with a common line to the Corner Homecare, Inc. property described in Deed Book 1053, Page 633, and the Geobillyn Corporation property described in Deed Book 534, Page 654, and the Robert E. Jones et al property described in Deed Book 626, Page 106, and the Chief Paducah Development Corporation property described in Deed Book 1080, Page 446 and Deed Book 1023, Page 261 to a 1/2" diameter rebar with cap (set), being the POINT OF BEGINNING, [all 1/2" diameter rebars and caps (set) are 1/2" diameter x 24" long rebars with plastic cap stamped "R. TOSH KYPLS 2900" unless otherwise noted]; THENCE from the POINT OF BEGINNING North 11 degrees 12 minutes 06 seconds East for a distance of 550.85 feet with a common line to the Chief Paducah Development Corporation property described in Deed Book 1080, Page 446, Deed Book 1023, Page 261 and Deed Book 573, Page 72 to a 1/2" diameter rebar with cap (found) 40.00 feet west at right angles from the centerline of the City of Paducah Flood Wall, [all 1/2" diameter rebars and caps (found) are 1/2" diameter x 24" long rebars with plastic cap stamped "D.H.Dummer PLS 1955"]; THENCE along a curve to the right having a radius of 1869.86 feet and an arc length of 105.64 feet, being subtended by a chord of South 38 degrees 24 minutes 02 seconds East for a distance of 105.62 feet with a common U11-1 line to the City of Paducah property described in Deed Book 200, Page 196 to a 1/2" diameter rebar with cap (found) 40.00 feet west at right angles from the centerline of the City of Paducah Flood Wall; THENCE South 36 degrees 46 minutes 55 seconds East for a distance of 152.76 feet continuing with a common line to the City of Paducah property to a 1/2" diameter rebar with cap (found) 40.00 feet west at right angles from the centerline of the City of Paducah Flood Wall; THENCE South 53 degrees 13 minutes 05 seconds West for a distance of 70.00 feet continuing with a common line to the City of Paducah property to a 1/2" diameter rebar with cap (found) 110.00 feet west at right angles from the centerline of the City of Paducah Flood Wall; THENCE South 36 degrees 46 minutes 55 seconds East for a distance of 81.16 feet continuing with a common line to the City of Paducah property to a 1/2" diameter rebar with cap (found) 110.00 feet west at right angles from the centerline of the City of Paducah Flood Wall; THENCE along a curve to the right having a radius of 844.93 feet and an arc length of 294.50 feet, being subtended by a chord of South 26 degrees 47 minutes 49 seconds East for a distance of 293.01 feet with a common line to the City of Paducah property to a 1/2" diameter rebar with cap (set) 110.00 feet west at right angles from the centerline of the City of Paducah Flood Wall; THENCE North 85 degrees 06 minutes 54 seconds West for a distance of 390.13 feet with a common line to Lots 6, 7 and 8 of the Starlite Plaza Subdivision Phase II to the POINT OF BEGINNING; Together with and subject to covenants, easements, right- of-ways and restrictions of record and in existence. Said property contains 2.6369 acres. The bearings described herein are based on a record bearing of South 11 degrees 12 minutes 06 seconds West along the west property line of the subject property as recorded in Plat Section "W', Page 1379. Deed Reference: Deed Book 260, Page 371. Will Reference: Will Book "XX", Page 564. SECTION 3. The Mayor is hereby authorized to execute a Deed of Conveyance between Max L. Edwards and wife, Lois Ann Edwards; Sterling D. Edwards and wife, Ondria Kay Edwards; Lake F. Edwards and wife, Randa Edwards; and Wanda T. Smith and husband, Robert Smith and the City of Paducah to transfer the real property accepted in Section 1 above to the City. SECTION 4.
