MEMBERS OF THE FIRE, POLICE, AND PUBLIC WORKS DEPARTMENTS FOR THE CITY OF PADUCAH WHEREAS, the City of Paducah desires to establish a policy and provide a procedure to facilitate an authorized "exchange of duty" between two employees of the Paducah Fire, Police, and Public Works Departments. BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah hereby establishes a policy of Exchange of Duty for members of the Fire, Police and Public Works Departments as follows: Upon approval of the Chief of the Fire or Police Department or the Director of Public Works (whichever is applicable) or the Assistant Chiefs to whom the Chief has delegated the authority or the Director's designee (whichever is applicable), an employee scheduled to work (hereinafter "scheduled employee") may request another employee of the same department, who has equal qualifications (hereinafter "substituting employee"), to exchange duties with him/her for one of the following reasons: a. Where the scheduled employee has depleted his sick and vacation time but continues to be unable to return to duty due to an illness or injury; b. Attendance at professional or union conferences or schools by the scheduled employee; C. Any official union business by the scheduled employee; or d. For personal business. 2. The substituting employee must request approval for the exchange of duty in writing to the applicable Chief, Director, and/or the applicable Assistant Chief or the Director's Designee no later than forty-eight (48) hours prior to the proposed exchange. 3. With respect to employees of the Fire Department, within six (6) months of the initial day of the exchange, the scheduled employee must work for the substituting employee in an amount of time equal to the time for which the substituting employee worked for the scheduled employee. However, the City shall pay the employees as if the employees had worked as scheduled. 4. With respect to employees of the Police Department, during the same pay _ period, the scheduled employee must work for the substituting employee in an amount of time equal to the time for which the substituting employee worked for the scheduled employee. The City shall pay the employees as actually worked, rather than as scheduled, including any overtime for which all employees incurred. 5. With respect to employees of the Public Works Department, during the same work -week, the scheduled employee must work for the substituting employee in an amount of time equal to the time for which the substituting Mll employee worked for the scheduled employee. The City shall pay the employees as actually worked, rather than as scheduled, although the pay should not be affected since the substitution must occur during the same work -week. 6. In addition, the following rules apply with respect to exchange of duty: a. the exchange must be voluntary on the part of the substituting employee; b. the exchange may not be due to the City's business operations, but must be due to the employee's desire to attend to personal matters; C. the exchange must be recorded by the Department and the record of the initial exchange, as well as the traded time, must be maintained by the Department; d. monthly reports must be prepared by the Department depicting any exchange/trade of duty activity, which shall be distributed to the Finance and Human Resources Departments; e. because police and public works employees are paid as worked, rather than as scheduled, the Finance Department must be notified immediately of any changes in schedule so that the pay checks can reflect the changes; f. failure of any employee to complete the required exchange/trade shall cause that employee to be restricted from any future exchange of duty for six (6) months, require the employee to submit a written explanation as to the reason(s) for this failure, and may subject the employee to further discipline at the discretion of the applicable Chief or Director.
