MUNICIPAL ORDER NO. 1364
A MUNICIPAL ORDER AUTHORIZING THE MAYOR TO EXECUTE A
DEED AND ALL DOCUMENTS NECESSARY FOR THE CITY OF PADUCAH TO
PURCHASE A STRIP OF LAND BEING 30' IN WIDTH WEST OF AND ADJACENT TO
BURNETT STREET BETWEEN NORTH SIXTH STREET AND THE OHIO RIVER,
PADUCAH, MCCRACKEN COUNTY, KENTUCKY, IN THE AMOUNT OF $7,000 FOR
THE DEVELOPMENT OF THE BOAT LAUNCH RAMP
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The City of Paducah hereby authorizes the Mayor to execute a
Deed and all other documents relating thereto between the City of Paducah and William C.
Yancy, Lee Anna Yancy, Lucy A. Yancy, Mary L. Smith and Joseph R. Smith, Frank H.
Yancy, Anita C. Yancy, Jo E. Yancy, John E. Yancy, and Nell Yancy for acquisition of a
portion (approximately 30' X 1272') of property west of and adjacent to Burnett Street
between North Sixth Street and the Ohio River, Paducah, McCracken County, Kentucky, in
the amount of $7,000 for the development of the boat launch ramp.
SECTION 2. That the property authorized in Section 1 above, heretofore
approved for acquisition, is more particularly described as follows:
A strip of land being thirty (30) feet in width west of and adjacent to
Burnett Street between North Sixth Street and the Ohio River,
Paducah, McCracken County, Kentucky, and being more particularly
described as follows:
Beginning at the point of intersection of the centerline of Burnett
Street with the north right of way line of North Sixth Street, said point
being located North 31 degrees 50 minutes 21 seconds East a distance
of 40.07 feet from an iron pin in a steel pipe (a City of Paducah
Engineers street monument) in the centerline of Burnett Street;
thence, from the point of beginning and with the said north right of
way line of North Sixth Street, North 62 degrees 04 minutes 48
seconds West a distance of 30.07 feet to the southeast corner of Lot 37
of the Flournoy, Norton, Trimble, and Harris Addition to the City of
Paducah as recorded in Deed Book "O" Page 230 of the records of the
McCracken County Court Clerk; thence, with the east line of the said
Lot 37, North 31 degrees 50 minutes 21 seconds East a distance of
96.51 feet to a concrete monument with a surveyors embedded iron pin
and cap set in the north right of way line of the Paducah Floodwall;
thence, continuing with the said east line of Lot 37, North 31 degrees
50 minutes 21 seconds East a distance of 250.00 feet to an iron pin
with a surveyors cap; thence, continuing with the said east line of Lot
37, North 31 degrees 50 minutes 21 seconds East a distance of 859.03
feet to a iron pin with a surveyors cap; thence, continuing with the
east line of Lot 37, North 31 degrees 50 minutes 21 seconds East a
distance of 163.69 feet to a point in the 302 contour line (low water
mark) of the Ohio River; thence, with the southern edge of the Ohio
River, South 45 degrees 15 minutes 29 seconds East a distance of
30.78 feet to a point in the west right of way line of Burnett Street;
thence, with the said west line of Burnett Street, South 31 degrees 50
minutes 21 seconds West a distance of 1360.31 feet back to the point
of beginning.

The above described parcel of land contains 0.9399 acres more or less
(40,943 sq.ft.) and is shown as the W.H. Yancy Heirs Tract on the plat
of record titled "Boundary Survey of the City of Paducah Property" as
recorded in Plat Section "L" Page 1821 of the records of the
McCracken County, Kentucky, County Court Clerks Office.
All iron pins referred to as set in the above description are 18" long %2"
ribbed steel rebar with a 1 %2" aluminum cap marked "F&H Engineers
LS 2547". All concrete monuments referred to as set are 4" diameter x
36" long with the same iron pin and cap imbedded and formed into the
monument. All points referred to as set were placed on May 24, 2007.
Being a part of the upper half of Lot 37, Division "F" of the Harris,
Flournoy, Trimble and Norton Addition to the City of Paducah of
record in Deed Book "O," page 230, McCracken County Court Clerk's
Office which was conveyed to W. H. Yancy by deed from Addie
Caldwell, individually and as executrix of the will of S. R. Caldwell,
dated February 25, 1918, of record in Deed Book 116, page 120,
McCracken County Court Clerk's Office.
Pursuant to Last Will & Testament of W. H. Yancy probated March
15, 1978, in Will Book "X", Page 739, all of his property was devised
to his wife, Martha Leota Yancy. She is now deceased and pursuant to
her Last Will and Testament probated October 5, 1992, in Will Book
"TT", Page 207, aforesaid Clerk's Office, all of her interest in property
was devised to her children, William Charles Yancy, Lucy Ann
Yancy, Mrs. Reggie Smith (a/k/a Mary L. Smith), Frank Hendron
Yancy, Jo Eva Yancy, and John Edd Yancy, Grantors herein.
SECTION 3. The expenditure of funds for said acquisition will be processed
through project number PF0039.
SECTION 4. This Order shall be in full force and effect from and after the
date of its adoption.
