At a Regular Meeting of the Board of Commissioners, held on Tuesday, September 2,
2008, at 5:30 p.m., Mayor Paxton presided, and upon call of the roll by the City Clerk,
the following answered to their names: Commissioners Coleman, Kaler, Smith, Watkins,
and Mayor Paxton (5).
WORKSHOP
BRIEFING ON CERS HAZARDOUS POSITION CLASSIFICATION
Stephanie Skinner, Human Resources Benefits Specialist, summarized the 2008
Legislative Changes for pension reform. Majority of changes will affect new hires that
begin participating with Kentucky Retirement Systems on or after September 1, 2008.
For hazardous or non -hazardous employees contributions will increase by 1 %. The 1 %
increase will be deposited to the KRS Insurance Fund. Retirement eligibility for
hazardous employees will be able to retire at any age with 25 years of service or at age
60, with 60 months of service. The non -hazardous employee will follow the Rule of 87
(member's age + yrs. of service and be a minimum of 57 years of age) or age 65, with a
minimum of 60 months of service. Health insurance benefits for non -hazardous will
require 15 years of earned service and the member will earn $10 per month for each year
of service towards their health insurance costs. Hazardous new hires health insurance
benefits will require 15 years of earned service and the member earns $15 per month for
each year of service towards their health insurance costs. As of September 1, 2008,
employer contributions for hazardous will increase to 29.50% and non -hazardous will
increase to 13.50%.
KRS 61.592 has been amended to change the definition for hazardous duty classification.
For employees hired on or after September 1, 2008, to be classified as hazardous their
duties require 1) frequent exposure to a high degree of danger or peril and high degree of
physical conditioning and 2) not being primarily clerical or administrative. All cities
must petition the KRS Board prior to October 1, 2008 to reclassify the positions due to
the change in the statue. The KRS Board will meet and determine positions that will be
classified hazardous with an effective date of December 1, 2008.
OFF-DUTY DUI POLICIES OF OTHER JURISDICTIONS
At a previous commission meeting, Mayor Paxton had requested Human Resources
Director Herschel Dungey to contact other cities to find out if they have an off-duty DUI
policy and if so, how it compares to Paducah's policy. Mr. Dungey reported he has
contacted ten different entities. Nicholasville, Litchfield and Carrolton cities have no
policy. Henderson's policy emulates Paducah's policy while other policies vary from
starting the disciplinary process to, if convicted, termination.
The Board discussed the current policy and alternatives. It was decided the current
policy should be revamped and directed Mr. Dungey to put together a draft policy to be
discussed at a workshop in the near future.
EXPENDABLE FUND BALANCE REPORT
Finance Director Jon Perkins reported at the closing of FY2008 there was $2.2 million in
excess of the 8% reserve; however, the City expended $550,000 to cover a health
insurance shortfall, $116,000 for the Greenway Trail match and $440,000 on the
riverfront redevelopment project, leaving a total excess of $1. lmillion. In the budget for
FY2009, the Commission ranked a priority list of 58 items totaling $2,129,130.00.
Commission was asked if they wanted to change the priority of the list since funding
available is $1.1M and only the first 32 items will be able to be funded if there are no
changes. The Commission elected not to change the list but did decide to transfer funds
in the amount of $105,000 from Commission Contingency to fund the Human Rights
Commission office budget.

Also, she had questions regarding regulations in historical zone for bed & breakfast
and lodging house.

Steve Ervin, Acting Director of Planning, explained the regulations and said the
lodging house regulations should be deleted from the ordinance.
Bill Griggs, Acting Director of Inspections, reported the property at 7th & Harrison is
in foreclosure. The permit for maintenance has not been completed and the owner
has fines in the amount of $27,000+ for property maintenance.
