HomeMy WebLinkAbout91-4-4587111 1— :_—, �,-, i Li_L—d��I,d�dklikud,,Jdl--_1_ r�L�LWul:Iduilkl"u l}.rhil ��od::Alk i I ,J L-,— i, ORDINANCE NO. 91-4-4587 AN ORDINANCE AMENDING CHAPTER 2, ADMINISTRATION, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY, 1\4 AND CREATING THE DEPARTMENT OF ENVIRONMENTAL AND ENGINEERING SERVICES WHEREAS, cities throughout the United States have been required and will continue to be required to be / actively involved in environmental protection and, in particular, with the enforcement of federal and state environmental protection laws and regulations; and WHEREAS, the City's environmental protection activities have heretofore been deemed a part of the functions and responsibilities of the Department of the City Engineer; and WHEREAS, the City's involvement over the last several years with environmental protection has become substantial and paramount to such extent that it is now necessary to create a department which shall have the primary function and responsibility of carrying out the City's obligations under environmental protection law; and WHEREAS, it is the intent of the Commission that the Department of City Engineer and the Sewer Works Department as set forth in ordinance be abolished, and that, all functions and responsibilities of the City Engineer and the Sewer Works Department be merged in the new department. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. Section 2-177 through Section 2-186, and Section 2-431 through Section 2-433 of Chapter 2, Administration, of the Code of Ordinances of the City of Paducah, Kentucky, are hereby abolished in their entirety. SECTION 2. The following provisions as described by the hereinafter referenced sections are deemed a part of the Code of Ordinances of the City of Paducah: DIVISION II DEPARTMENT OF ENVIRONMENTAL AND ENGINEERING SERVICES "Section 2-177. Department established. There is hereby created and established a department to be known as the Department of Environmental and Engineering Services. "Section 2-178. Position created; general powers and duties. There is hereby created and established the position of Director of the Department of Environmental and Engineering Services. The Director shall have the general responsibility of supervising the various functions of the department. The Director shall also be deemed the City Engineer and shall have the responsibility of providing the general engineering services for the City. The Director shall have all general authorities and powers necessary to 112 carry out these responsibilities. The position of Director of the Department of Environmental and Engineering Services shall be deemed non -civil service. "Section 2-179. Responsibilities and functions of department. The Department of Environmental and Engineering Services shall have the following responsibilities and functions: 1) To generally administer and enforce the ordinances of the City which relate to environmental regulation, including, but not limited to, the discharge, collection, disposal and treatment of waste water, storm water and other regulated pollutants and toxic waste. 2) To generally administer and operate the City's facilities relating to the collection, disposal and treatment of waste water, storm water, and the other regulated pollutants and toxic waste. 3) To assist any federal or state regulatory agency or department in the enforcement of environmental protection laws and regulations and to provide any necessary reporting documentation, studies, or other related documents or services as may be required by either federal or state law. 4) To generally administer and operate the City's floodwall works. 5) To prepare or review and approve all design plans and specifications relating to the repair, replacement or construction of all public streets, alleys, sewers, sidewalks, curbs, gutters, bridges and culverts within the City and to ensure that any repair, replacement or construction of same shall be in compliance with all applicable federal, state or city law. 6) To do and perform any other responsibility and function as assigned by the City Commission or City Manager." SECTION 3. This ordinance shall be read on two separate days and will become effective upon publication of title and a certified summary thereof. GERRY B.
