MARY HIGH SCHOOL OF PADUCAH, INC., A PERPETUAL ACCESS EASEMENT LOCATED WEST OF HIGHLAND BOULEVARD, PADUCAH, KENTUCKY AND PRESENTLY HELD BY THE CITY OF PADUCAH FOR THE USE AND BENEFIT OF THE PADUCAH WATER WORKS. r WHEREAS, the Board of Commissioners of Water Works, having requested the Board of Commissioners of the City of Paducah, Kentucky to adopt an ordinance authorizing the conveyance to St. Mary High School of Paducah, Inc., a perpetual access easement located west of Highland Boulevard, Paducah, Kentucky, and presently held by the City of Paducah for the use and benefit of the Paducah Water Works; said Board having filed a copy of its resolution, adopted on 301ga ; and it appearing to the Board of Commission rs of he City of Paducah, Kentucky, that said conveyance would be in the best interest of the community and all concerned; BE IT ORDAINED by the City of Paducah, Kentucky: SECTION ONE That the City of Paducah does hereby authorize and direct the Mayor and City Clerk to convey to St. Mary High School of Paducah, Inc. a permanent and perpetual easement for purposes of ingress and egress from the real property of St. Mary High School of Paducah, Inc. over and across the real property of the City of Paducah for the use and benefit of the Paducah Water Works to Highland Boulevard. Said easement being more particularly described as follows: Being a strip of land forty-five feet in width located adjacent and contiguous to the southerly line of Tract No. 1 of the Paducah Water Works Forest Hills Reservoir site as shown by plat of said tract of record in Plat Section "J", page 1395, of the McCracken County Court Clerk's Office, said strip of land being more particularly described as follows: Beginning at a steel rod set where the southerly line of the aforesaid Tract No. 1 intersects the westerly right-of-way line of Highland Boulevard, said point of intersection also being the Northeast corner of Tract No. 2 as shown by the aforesaid plat of record; thence S. 680-56'-13" W. along and with the division line between said Tracts No. 1 and 2, a distance of 521.78 feet to a steel rod set at the southwest corner of said Tract No. 1 on the easterly line of the property described in Deed Book 633, page 279, of the aforesaid Clerk's Office; thence N. 200-40'-36" W. along and with said easterly line, the same being the westerly line of said Tract No. 1, a distance of 45.00 feet; thence N. 680-56'-13" E. along a line 45.00 feet north of and parallel with the aforesaid southerly line of said Tract No. 1, a distance of 521.48 feet to the westerly right-of-way line of Highland Boulevard; thence S. 210-03'-47" E. along and with said right-of-way line, 45.00 feet to the point of beginning. ...�_....�».,« I� •�r,.. ,._......4�.1�._.— �.. .,_ �._,.,....,,.. „_.., iL_�..,:<L� -_e�L l�_�•=m,li,�:1� u- LLxi� gid. LL -a �dllhmi :�•�ha� L 1 165 The aforesaid easement contains 23,473.3 square feet or 0.539 acre with the bearings in this description being based upon those bearings shown on the aforesaid plat of record. SECTION TWO The corporate counsel of the City of Paducah, Kentucky is hereby authorized, empowered and directed to prepare for the Mayor and City Clerk's signatures, an easement from the City of Paducah, Kentucky to St. Mary High School of Paducah, Inc. the aforesaid perpetual easement 'located west of Highland Boulevard, Paducah, Kentucky, and any and all documents necessary to effectuate this transfer. SECTION THREE In order to accommodate St. Mary High School of Paducah, Inc. and expedite the transfer of this easement so that construction may be begun by St. Mary High School of Paducah, Inc. on the new educational facility, an emergency is hereby declared to exist and this ordinance shall become effective with one reading.
