ORDINANCE NO. 89-4-4231
AN ORDINANCE APPROVING THE FINAL REPORT OF THE
PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDI-
VISION OF PROPERTY OF MAGNOLIA VILLAGE SUBDIVISION LOCATED
BETWEEN LONE OAK ROAD AND NORTH FRIENDSHIP ROAD, AND AC-
CEPTING THE DEDICATION OF PUBLIC RIGHTS-OF-WAY AND EASEMENTS
AND SETTING BOND AMOUNT
WHEREAS, the Paducah Planning Commission, at a
meeting held on March 6, 1989, adopted a preliminary report,
a plat of Magnolia Village Subdivision, and by Resolution
dated March 6, 1989, recommended to the Board of Commis-
sioners of the City of Paducah, Kentucky, the adoption of an
ordinance approving the final plat of said subdivision
reflected thereon, and accepting the dedication of the
public rights-of-way and easements shown thereon; and
WHEREAS, pursuant to Section 12(2)(b) the City
Engineer has recommended that a performance bond or an
approved letter of credit by a bank licensed to conduct
business in the State of Kentucky in the amount of
$440,000.00 for construction of streets, storm drainage
systems, sanitary sewers, water lines, monuments, and other
designated public improvements.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution adopted by the
Paducah Planning Commission on March 6, 1989, entitled, "A
RESOLUTION,,CONSTITUTING THE FINAL REPORT OF THE PADUCAH
PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY
OF MAGNOLIA VILLAGE SUBDIVISION LOCATED BETWEEN LONE OAK
ROAD AND NORTH FRIENDSHIP ROAD", be approved as the final
report of said Commission respecting the matters set forth

therein.
SECTION 2. That the subdivision of said property
shall be, and it is hereby, approved as shown on the plat
referred to in said subdivision, which plat is entitled,
"Magnolia Village", and said property is hereby declared to -
be subdivided as shown on said plat.

SECTION 3.
That the dedication of the public
rights-of-way and public utility easements shown on said
plat shall be, and they are hereby, accepted, but such
acceptance shall no constitute an undertaking on the part of
this Board or the City of Paducah, Kentucky, for the con-
struction, improving or maintaining of said right-of-way,
that being a matter for separate consideration and action.
The Mayor is hereby authorized to subscribe a certificate of
approval on the plat.
SECTION 4. That pursuant to Section 12(2)(B) of
the Paducah Subdivision Ordinance, a performance bond or an
approved letter of credit by a bank licensed to conduct
business in the State of Kentucky in the amount of
$440,000.00, with approved corporate surety, and running to
the City of Paducah, is set and that said bond or letter of
credit shall be in such form and containing such contents
that meet the approval of the City Engineer and the Corpora-
tion Counsel of the City of Paducah.
SECTION 5. That if any section, paragraph or
provision of this ordinance shall be found to be inopera-
tive, ineffective or invalid for any cause, the deficiency
or invalidity of such section, paragraph or provision shall
not affect any other section, paragraph or provision hereof,
it being the purpose and intent of this ordinance to make
each and every section, paragraph and provision hereof
separable from all other sections, paragraphs and provi-
sions.
SECTION 6. This ordinance shall be read on two
separate days and will become effective upon publication of
title and a certified summary thereof.
