ORDINANCE NO. 91-12-4702
AN ORDINANCE AMENDING ORDINANCE NO. 91-11-4694,
APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING
COMMISSION RESPECTING PHASE A OF STINESPRING ESTATES
SUBDIVISION, LOCATED ON THE WEST SIDE OF HOLT ROAD, AND AC-
CEPTING THE DEDICATION OF PUBLIC RIGHTS-OF-WAY AND EASEMENTS
AND SETTING BOND AMOUNT
WHEREAS, the Paducah Planning Commission, at a
meeting held on June 14, 1989, adopted as a preliminary
report, a plat of the proposed subdivision, and by
Resolution dated October 7, 1991, recommended to the Board
of Commissioners of the City of Paducah, Kentucky, the
adoption of an ordinance approving the final plat of said
subdivision reflected thereon, and accepting the dedication
of the public rights-of-way and easements shown thereon; and
WHEREAS, pursuant to Section 12(2)(B) the City
Engineer has recommended a performance bond or an approved
letter of credit in the amount of $250,000.00 to be posted
by Ted Herpel for construction of streets, storm drainage
systems, sanitary sewers, water lines, monuments, and other
designated public improvements.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That a resolution adopted by the
Paducah Planning Commission on October 7, 1991, entitled, "A
RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH
PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY
OF STINESPRING ESTATES SUBDIVISION LOCATED ON THE WEST SIDE
OF HOLT ROAD AND BEING 2,100 FEET NORTH OF BLANDVILLE ROAD",
be approved as the final report of said Commission respect-
ing the matters set forth therein.
SECTION 2. That the subdivision of said property
shall be, and it is hereby, approved as shown on the plat
referred to in said subdivision, which plat is entitled,
"Phase 'A', Stinespring Estates Subdivision", and said
property is hereby declared to be subdivided as shown on
said plat.
SECTION 3. That the dedication of the public
rights-of-way and public utility easements shown on said
plat shall be, and they are hereby, accepted, but such
„ ) acceptance shall not constitute an undertaking on the part
of this Board or the City of Paducah, Kentucky, for the con-
struction, improving or maintaining of said right-of-way,
that being a matter for separate consideration and action.
The Mayor is hereby authorized to subscribe a certificate of
approval on the plat.

SECTION $5. That if an section,

tive, ineffective or invalid for any cause, the deficiency
or invalidity of such section, paragraph or provision shall
not affect any other section, paragraph or provision hereof,
it being the purpose and intent of this ordinance to make
each and every section, paragraph and provision hereof
separable from all other sections, paragraphs and provi-
sions.
SECTION %6. An emergency is hereby declared to
exist since the ordinance approving this subdivision was
adopted on November 12, 1991, with the omission of a bond or
approved letter of credit pursuant to Section 12(2) B of
the Paducah Subdivision Ordinance. This ordinance shall
become effective immediately with one reading.
SECTION 7. This ordinance will be published upon
summary publication pursuant to KRS Chapter 424.
