AN ORDINANCE ESTABLISHING POLICY FOR THE OPERATION OF
ANIMAL DRAWN VEHICLES IN THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1.
"Restrictions" are hereby created and
ordained to read as follows:
"No person shall operate or cause to be operated for
hire any vehicle, of whatever nature, drawn by animals for the
purpose of conducting tours within the City or the Old and
Historic District, except animal drawn vehicles as provided in
this ordinance."
SECTION 2. "Passenger Loading" is hereby created and
ordained to read as follows:
"(A) Animal drawn vehicles may pick up or discharge
passengers at any passenger loading zone, any designated hack
stand, and at such other locations as are approved by the City
Commission.
"(B) Animal drawn vehicles may originate and
terminate tours on Broadway within the Carriage Corner area
designated for horse/carriage traffic."
SECTION 3. "Route Limitations" are hereby created
and ordained to read as follows:
"Animal drawn vehicles may operate on street or
public ways in the City as approved by the City Commission.
Animal drawn vehicles may operate between the hours of
and unless the operator receives prior written consent
from the City Manager."
SECTION 4. "Drivers" are hereby created and ordained
to read as follows:
"All drivers of animal drawn vehicles shall have a
current automobile vehicle drivers license, be at least
eighteen (18) years of age, and demonstrate competence in
handling animal drawn vehicles."
SECTION 5. "Diapering Apparatus Required" is hereby
created and ordained to read as follows:
"It shall be unlawful for any person, firm,
corporation or other entity to utilize any animal for the
purpose of pulling any vehicle on City streets unless such
animal is equipped with diapering apparatus which prevents the
droppings of such animal from being deposited or otherwise left
on City streets. It shall be the responsibility of the person,
firm, corporation or other entity utilizing any animal for the
purpose of pulling a vehicle to ascertain that the diapering
apparatus is maintained in working order at all times. It
shall be the responsibility of the operator to see that the
diapering apparatus is in good working order at all times and

that proper disposal of droppings of performed. The City shall
charge a fee for the cleanup of any droppings left on public
rights-of-way by the operation of the animal drawn vehicle."
SECTION 6.° "Required.City Business License" is
hereby created and ordained to read as follows:
"No animal drawn vehicle shall operate on City
streets without a duly issued city business license and without
having paid such fee therefor as the City Commission may, from
time to time, establish. This license must be permanently
affixed to the vehicle in a location approved by the
Commission."
SECTION 7. "Standards for Animal Drawn Vehicles" is
hereby created and ordained to read as follows:
"All animal drawn vehicles shall be automatically
styled passenger carriages which are aesthetically pleasant and
comport with the downtown riverfront area. Wagons which
patently were designed for cargo instead of passengers will not
be approved. All animal drawn vehicles shall have adequate
brakes and shall have adequate front and back lights, which
f back lights shall include brake lights. All animal drawn
vehicles shall also contain sufficient reflective material so
as to ensure for visibility. Furthermore, all animal drawn
vehicles shall at all times be maintained so as to ensure the
safety of the passengers and the general public. The City
Manager is hereby accorded the authority to promulgate such
other regulations as to carry out the intent of this section."
SECTION 8. "Care of Animals" is hereby created and
ordained to read as follows:
"All licensees under this chapter shall operate the
animal drawn vehicle in such a manner so as not to endanger or
be otherwise inimicable to the health and safety of the animals
which draw the vehicles. The City Manager is hereby accorded
the authority to promulgate such other regulations as to carry
out the intent of this section."
SECTION 9.
"Permit to Operate Animal Drawn Vehicle"
is hereby created and ordained to read as follows:

"(A) An applicant for a permit shall provide the
1. Adequate identification of the applicant and
animal drawn vehicle and proof of ownership
2. Material setting forth characteristics of the
vehicle, including its dimensions, weight and
passenger capacity
3. Color photographs not less than eight (8) inches
by ten (10) inches of all four (4) sides of the
vehicle or sketches of a similar make and model
of the vehicle

4. Adequate proof of liability insurance with PIP
coverage in the following amounts:
a) Not less than $100,000.00 in limited
liability per occurrence
b) Not less than $300,000.00 in public
liability per occurrence
c) Not less than $50,000 for property damage
per occurrence
d) The.City of Paducah shall be named as an
additional insured.
5. Satisfactory proof of health inspections of the
animal(s) to be utilized in drawing the vehicle
6. A fee established by the City Commission
7. After approved, but prior to issuance, a current
city business license
8. Evidence of satisfactory annual safety and
appearance inspection of tack and equipment,
including devices that prevent droppings from
being left on City streets.
9. Evidence of compliance with all standards of
design and safety of this chapter

"B. Inspection for compliance shall be performed by
the city animal warden, or such other individual as designated
by the Chief of Police. In the event of compliance, the
inspector shall certify such compliance to the city license
auditor, who shall then issue a permit upon payment of the
fee."
SECTION 10. "Penalty" is hereby created and ordained
to read as follows:
"A. Any violations of the provisions of this chapter
shall cause the suspension or revocation of the permit to
operate an animal drawn vehicle in the City of Paducah.
"B. Any person who violates the provisions of this
chapter shall be fined up to $100.00, imprisoned up to thirty
(30) days, or both. Each violation shall constitute a separate
offense."
SECTION 11. In the event of a complaint against the
owner or operator of an animal drawn carriage concerning the
safe, humane and proper operation of the service, prior to any
action being taken by the Board of Commissioners, a hearing
will be held before said Board pursuant to established
Commission hearing procedures.
SECTION 12. This ordinance shall be read on two
separate days and will become effective upon summary
publication pursuant to KRS Chapter 424
