HomeMy WebLinkAbout92-3-4742456 ORDINANCE NO. 92-3-4742 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDI- VISION OF PROPERTY OF RICHARD FAIRHURST LOCATED IN AN AREA �1 BOUNDED BY OAKCREST DRIVE, SPRINGWELL LANE AND PINECREST DRIVE, ACCEPTING THE DEDICATION OF PUBLIC EASEMENTS, AND SETTING BOND AMOUNT WHEREAS, the Paducah Planning Commission, at a meeting held on February 3, 1992, adopted as a preliminary report, a plat of West Vale Subdivision, and by Resolution dated March 2, 1992, recommended to the Board of Commis- sioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and accepting the dedication of easements shown thereon; and WHEREAS, pursuant to Section 12(2)(b) the City Engineer has recommended that a performance bond or an -._ approved letter of credit by a bank licensed to conduct business in the State of Kentucky in the amount of $30,000.00 for construction of sanitary sewers and monuments, and other designated public improvements. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on March 2, 1992, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF PROPERTY OF RICHARD FAIRHURST LOCATED IN AN AREA BOUNDED BY OAKCREST DRIVE, SPRINGWELL LANE AND PINECREST DRIVE", be approved as the final report of said Commission respecting the matters C+' set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled, "West Vale Subdivision", and said property is hereby declared to be subdivided as shown on said plat. 457 SECTION 3. That the dedication of the public access and utility easements shown on said plat shall be, and they are hereby, accepted, but such acceptance shall not constitute an undertaking on the part of this Board or the City of Paducah, Kentucky, for the construction, improving or maintaining of said easements, that being a matter for separate consideration and action. The Mayor is hereby authorized to subscribe a certificate of approval on the plat.] SECTION 4. That pursuant to Section 12(2)(B) of the Paducah Subdivision Ordinance, a performance bond or an approved letter of credit by a bank licensed to conduct business in the State of Kentucky in the amount of $30,000.00 with approved corporate surety, and running to the City of Paducah, is set and that said bond or letter of credit shall be in such form and containing such contents that meet the approval of the City Engineer and the Corpora - NI/ tion Counsel of the City of Paducah. SECTION 5. That if any section, paragraph or provision of this ordinance shall be found to be inopera- tive, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provi- sions. SECTION 6. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. Z' ;��7 GE B.
