ORDINANCE NO. 92-01-4708
AN ORDINANCE AMENDING SECTIONS 33-2, 33-9, 33-10,
33-54 AND 33-67, OF CHAPTER 33, SEWERS, OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. Section 33-2, Definitions, is hereby
amended to read as follows:
"Significant Noncompliance. Violations which meet
one or more of the following criteria:
"(4) Any discharge of a pollutant that has caused
imminent endangerment to human health, welfare
or to the environment or has resulted in the
POTW's exercise of its emergency authority
under Section [3211017] 33-55, the chapter to
halt or prevent such a discharge."
SECTION 2. Section 33-9, Prohibited Sewer Deposits,
is hereby amended to read as follows:
"(8) Any waters or wastes containing a toxic or
poisonous substance or any other materials in
sufficient quantity [ZA] to injure or interfere
with any sewage treatment process or constitute
a hazard to humans or animals [U] or create
any hazard in the receiving stream at the
sewage treatment plant.
(10) Any substance which will cause the POTW to
violate its NPDES and/or state disposal system
permit or the receiving stream quality stan-
dards."
SECTION 3. Section 33-10, Permit Required for
Private Collectors, is hereby amended to read as follows:
"No waste collected from septic tanks or similar
disposal containers shall be disposed of by the City
for any private collector of such waste unless such
person has obtained [airi/�i¢lt�t�X/aiiK�(t/�z�d►
a waste hauler permit upon completion
of a waste hauler application."
SECTION 4. Section 33-54, Administrative Penalties,
is hereby amended to read as follows:
"Any user who is found to have violated any provision
of this chapter, or the order and permits issued
hereunder, shall be fined in an amount not to exceed
five thousand dollars ($5,000) per violation. Each
day on which noncompliance shall occur [on] or
continue shall be deemed a separate and distinct
violation. Such assessments may be added to the
user's next scheduled sewer service charge and the
Director shall have such other collection remedies as
he has to collect other service charges."
SECTION 5. Section 33-67, Rates Established for
Premises Inside City Limits, is hereby amended to read as
follows:
"Rates and charges for use of the service and
facilities of the municipal sewer system for premises
inside the corporate limits of the City, as such
limits presently exist and as the same may be extended

from time to time in the future, shall be at the rate
of
six
dollars and ninety cents ($6.90) per month for the
first five thousand (5,000) gallons or less of water
consumption, and at the rate of one dollar and
thirty-eight cents ($1.38) per one thousand (1,000)
Cgallons of water used in excess of five thousand
(5,000) gallons."
SECTION 6. This ordinance shall be retroactive to
December 2, 1991.
SECTION 7. In order to comply with State and Federal
Regulations implemented by the City of Paducah on December 2,
1991, an emergency is hereby declared to exist and this
ordinance shall become effective immediately with one reading.
SECTION 8. This ordinance shall be published by
title and a certified summary pursuant to KRS Chapter 424.
