AN ORDINANCE ABOLISHING AND RECREATING SECTION 40.16,
PARKING REQUIREMENTS, OF APPENDIX A -ZONING, OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY:
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. Sec. 40.16, Parking requirements, is hereby
recreated and reordained to read as follows:
1140.16. Parking Requirements.
40.161. Intent.
It shall be the intent of this article to provide
guidance for district parking, loading/unloading standards as
required by this zoning ordinance. Unless otherwise provided for
in the individual districts regulations, this section shall
govern. Furthermore this section is intended:
1. To insure that adequate maneuvering, circulation,
and points of ingress and egress are provided.
2. To provide an adequate number of off street park-
ing spaces and loading, /unloading bays and maneu-
vering areas for every property use.
3. To insure that individual parking sizes will be
large enough for the intended use of specific
properties.
4. To provide a safe and efficient interface between
the street and road system and the parking and
loading/ unloading areas.
40.162. General Parking Regulations.
The following parking and loading/unloading require-
ments represent minimum standards. Applicants are urged to
properly assess their respective needs and provide additional
space as needed.
1. Location on Other Property: If the required park-
ing spaces cannot reasonably be provided on the
same lot on which the principal use is conducted,
such spaces may be provided on other off-street
property within four hundred (400) feet of the
main entrance to the principal use. Such spaces
shall be associated with principal use and shall
not thereafter be reduced or encroached upon in
any manner. Furthermore, when parking space must
be provided on such other property, a written
agreement signed by the owners of the subject
properties must accompany the application for a
parking layout.
2. Variance: When it can be clearly shown that an
intended use shall require less parking or load-
ing/unloading areas than what is required by this
section because of significant variation in opera-
tion or activity, the Planning Commission may
grant a reduction in the parking and loading/ -
unloading requirements.
J/ 3. Applicability: Off street parking, loading/ -
unloading shall be provided for any new building
constructed; for new uses or conversion of exist-
ing, conforming buildings; or for enlargements of
existing structures.
(a) For new use, conversions or enlargements of
existing, conforming buildings, off-street

with these regulations shall be provided for
the entire facility.
(b) For enlargements of existing structures which
do not conform to these regulations, required
parking must equal the sum of those spaces
furnished by the use prior to the enla
and the number of spaces required by these
regulations for any additional use area.
4. Multiple uses on a Site: For sites with more than°
one (1) use, the parking requirement shall be the
sum of spaces required for each use, except as
adjusted pursuant to section 40.1691.
5. Exemptions: Any use within the B-2, B -2T, and the
H-1 business districts are exempt from the off-
street parkina requirements provided by 40.164 and
40.165. Any off-street parking facility con-
structed in these districts after the effective
date of this article [May ?, 19921 must comply
with the design standards set forth in Section
40.164, 40.166 40.167, 40.168.
40.163. Lot Review.
All lots or portions of lots being developed for
vehicular parkina which contain at least four (4) spaces, or at
least one (1) loading/unloading area that provide one (1) space,
shall have the design approval of the Planning Department and the
Department of Engineering and Environmental Services prior to
issuance of any building permit. Those administrative officials
shall insure that the intent and specific provisions of this
section are observed.
40.164. Off -Street Parking Requirements for Residen-

When computing_ Number of Seats and GFA or GLA
for parking:
Where no individual seating (such as and like
sports facilities and places of worship) is
provided, every 24 inches will be considered
a seat.
When calculating GFA and GLA, fractions up to
one-half (Z) shall be disregarded, and
fractions of one-half (J) or more shall
reauire one (1) Darkina space.
When calculatina the reauired Darkina for a
specific intended use does not appear in this
section, the Zoning Administrator shall make
a determination of similar use that does
appear in this section.
40.166. Number of Off -Street Loading Spaces

40.167. Parking, Loading/Unloading Area General
Design Requirements.
1. Off -Street areas for maneuvering and
circulation shall equal the number of
spaces or area required and shall be of
useable shape and surface and have
convenient ingress and egress. Aisles
and access drives shall be designed so
as to provide adequate vehicular
maneuvering upon the property being
served and in no case shall off-street
parking areas be permitted which
encourage or require the backing onto or
maneuvering within any public right-of-
way, except residential uses and in
alley ways. But residential parking
areas shall not permit backing onto
arterial streets, or streets designated
as federal or state highways.
2. Where raised channeling devices,
internal landscaping, and other similar
geometrics are utilized, they shall
count as being of "useable shape and
surface" as required in (a) above.
3. Where parkinq areas are provided for
four (4) or more vehicles, they shall be
improved within six (6) months of
application with any base material with
an asphaltic, bituminous, cement or
other properly bound surface, so as to
be durable and dustless, and shall be
graded and drained so as to dispose of
all surface water accumulation within
the areas without carrying said water
accumulation over a public sidewalk.
The aforementioned surface and drainage
requirements shall be reviewed and
approved by DEES.
4. Any lighting used to illuminate such
off-street parking_ and loading/unloading
areas shall be so arranged as to reflect
away from any adjoining properties or
uses and any public right-of-way.
5. Traffic Visibility sight triangle
required:
All points of ingress and egress shall
maintain sight triangles as depicted in
Figure 1. Landscaping shall not exceed
24" in height above grade.

7. Parkina lots and loading/unloading areas
shall be kept reasonably free of dirt, trash
and other loose debris. These areas shall
also be kept reasonably well maintained free
of pot -holes and other decay.
8. Access Design Requirements:
Functional Classification of Streets to be
determined by Department of Planning.
a) Entrances and Exits - One-way entrances
and exits shall be at least fifteen (15)
feet wide. Two-way entrances and exits
shall be at least twenty-four (24) feet
wide for minor streets and thirty (30)
feet wide for arterial or collector
streets.
b) Curb Cuts: All curb cuts shall be
subject to review and approval by the
Department Engineering and Environmental
Services.
c) Minimum Space Sizes:

40.1691. Adjustment for Mixed Use Developments.
The Planning Commission may authorize an adjustment in
the total parking requirement for separate uses located
on the same site or for separate use located on adjoining
sites and served by a common parking facility.
a) An application for such an adjustment must
include a site plan showing location of parking and
extent of various uses, the requested reduction in
the parking requirement; and supporting data
addressing why such a reduction should be
permitted. "
SECTION 2. That if any section, paragraph or provision
of this ordinance shall be found to be inoperative, ineffective
or invalid for any cause, the deficiency or invalidity of such
section, paragraph or provision shall not affect any other
section, paragraph or provision hereof, it being the purpose and
intent of this ordinance to make each and every section,
paragraph, and provision hereof separable from all other
sections, paragraphs and provisions.
SECTION 3. This ordinance shall be read on two
separate days and will become effective upon summary publication
pursuant to KRS Chapter 424.
