AN ORDINANCE CLOSING A PORTION OF YEISER STREET LYING
WEST OF WHAYNE SULLIVAN DRIVE AND SOUTH OF NEW YEISER STREET
WHEREAS, John Ellis and the Kentucky Transportation
Cabinet, have requested that a portion of the rights-of-way known
as Yeiser Street, lying west of Whayne Sullivan Drive and south
of New Yeiser Street, be closed; and
WHEREAS, the Planning Commission approved these clos-
ings on July 20, 1992; and
WHEREAS, the Board of Commissioners finds that these
rights-of-way are unimproved and are not needed as public rights- ✓
of -way; and
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah does hereby author-
ize the closing of a portion of Yeiser Street lying on the west
side of Whayne Sullivan Drive and south of New Yeiser Street,
which are more particularly described as follows:
Beginning at a point marking the northeast corner of
the John Ellis property at the northwest corner of the
Mary Heflin property and in the south right of way line
of Yeiser Street to be closed; thence in a westerly
direction along the south right of way line of Yeiser
Street, 115.0 feet to a point; thence with an interior
angle of 90 degrees 00 minutes 45 seconds and in a
northerly direction 10.3 feet to a point in the south
right of way line of New Yeiser Street; thence with an
1 interior angle of 125 degrees 51 minutes 42 seconds and
in an easterly direction across the arc of a curve to
the left, 30.32 feet to a point in the north right of
way line of Yeiser Street to be closed; thence with an
interior angle of 137 degrees 43 minutes 46 seconds and
in an easterly direction along the north right of way
line of Yeiser Street, 92.0 feet to a point; thence
with an interior angle of 90 degrees 00 minutes 45
seconds and in a southerly direction, 30.0 feet to the
point of beginning. Said area contains 0.07 acres.
SECTION 2. The City is approving the closing of the
right-of-way contingent upon the adjoining property owners grant-
ing to the City a permanent utility easement thereon, over and
under the right-of-way being closed.
SECTION 3. The Corporation Counsel of the City of
Paducah, Kentucky, is hereby authorized, empowered and directed
to institute and prosecute, pursuant to KRS 82.405, an action in
McCracken Circuit Court for a judgment ordering the closing of
the streets and alley described in Section 1 above.
SECTION 4. This ordinance shall be read on two
separate days and will become effective upon summary publication
pursuant to KRS Chapter 424.
