ORDINANCE NO. 90-9-4499
ORDINANCE PROVIDING FOR THE CONVEYANCE TO THE BISHOP OF
THE OWENSBORO DIOCESE OF THE ROMAN CATHOLIC CHURCH OR HIS
ASSIGNS, 4.649 ACRES OF REAL PROPERTY LOCATED ON HIGHLAND
BOULEVARD, PADUCAH, KENTUCKY AND PRESENTLY HELD BY THE CITY OF
PADUCAH FOR THE USE AND BENEFIT OF THE PADUCAH WATER WORKS.
WHEREAS, the Board of Commissioners of Water Works,
having requested that the Board of Commissioners of the City of
Paducah, Kentucky adopt an ordinance authorizing the conveyance
to the Bishop of the Owensboro Diocese of the Roman Catholic
Church or his assigns, 4.649 acres of real property located on
Highland Boulevard, Paducah, Kentucky, and presently held by the
City of Paducah for the use and benefit of the Paducah Water
Works; said board having filed a copy of its resolution, adopted
on the 7th day of September, 1990; and it appearing to the Board
of Commissioners of the City of Paducah, Kentucky, that said con-
veyance would be in the best interest of the community and all
concerned;
BE IT ORDAINED by the City of Paducah, Kentucky:
SECTION 1 That the City of Paducah does hereby authorize and
direct the Mayor and City Clerk to convey by general
warranty deed to the Bishop of the Owensboro Diocese
of the Roman Catholic Church, or his assigns, 4.649
acres of real property located on Highland Boulevard,
Paducah, Kentucky; said property being more par-
ticularly described on Exhibit "A" which is attached
hereto and made a part hereof.
This conveyance by the City of Paducah, Kentucky,
shall be for and in consideration of the simultaneous
transfer and conveyance by the Bishop of the
Owensboro Diocese of the Roman Catholic Church to the
City of Paducah, Kentucky, for the use and benefit of
Paducah Water Works, its successors and assigns, by
general warranty deed, of approximately four acres of
real property generally located south of Elmdale Road
and east of Glenwood Road, together with any ease-
ment or easements which in the opinion of the engi-
neers for the Paducah Water Works are necessary for
reasonable ingress and egress in and to the aforesaid
real property, plus the further consideration of
$95,000.00 payable by the Bishop of the Owensboro
Diocese to Paducah Water Works.
SECTION 2 The Corporate Counsel of the City of Paducah,
Kentucky is hereby authorized, empowered and directed
to prepare for the Mayor and City Clerk's signatures,
a general warranty deed from the City of Paducah,
Kentucky to the Bishop of the Owensboro Diocese Roman
Catholic Church or his assigns of the aforesaid 4.649
acres of real property located on Highland Boulevard,
Paducah, Kentucky and any and all documents necessary
/ to effectuate this transfer.

SECTION 3 This ordinance shall be read on two separate days and
will become effective upon publication of title and a
certified summary thereof.
