HomeMy WebLinkAbout93-5-4942131 ORDINANCE NO. 93-5-4942 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE ZONING OF PROPERTY LOCATED BETWEEN U.S. HIGHWAY 60, 62 AND OLIVET CHURCH ROAD, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH ZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on May 17, 1993, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE ZONE ASSIGNMENT FOR PROPERTY LOCATED IN THE PADUCAH INFORMATION AGE PARK FROM R-1, LOW DENSITY RESIDENTIAL TO POP, PLANNED OFFICE PARK ZONE," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following property be, and it is hereby, zoned POP, Planned Office Park: Beginning at a concrete monument found at the northwest corner of the lands now or formerly owned the Greater Paducah Economic Council (Deed Book 760, Page 504); thence, with the west line of the Greater Paducah Economic Development Council property and the existing corporate limits of the City of Paducah, South 19.29' 45" West a distance of 945.33 feet to an iron pin found at the northeast corner of the lands now or formerly owned by William T. Stewart, Jr.,et al (Deed Book 683, Page 212); thence, leaving the existing corporate limits of the City of Paducah and with the north line of said Stewart property, North 820 44' 17" West a distance of 652.86 feet to an iron pin found at a corner common to the lands now or formerly owned by James H. Peyton (Deed Book 292, Page 60); thence, with the east line of said Peyton property, North 30 21' 06" West a distance of 1626.13 feet to an iron pin found at the southwest corner of Gerald Lotz property; thence, with lines common to said Lotz property, North 790 55' 17" East a distance of 30.16 feet to an iron pin, North 790 28' 47" East a distance of 90.76 feet to an iron pin, and North 30 19' 37" West a distance of 284.92 feet to an iron pin found on the south right-of-way line of U.S. Highway 60; thence, with the south right-of-way line of U.S. Highway 60, North 70 29' 49" East a distance of 104.09 feet to an iron pin found at a corner common to the lands now or formerly owned by James Williams (Deed Book 689, Page 769); thence, with lines common to the said Williams property as follows: South 150 05' 37" East a distance of 152.30 feet to an iron pin, South 780 01' 03" West a distance of 12.15 feet to an iron pin, South 120 52133" East a distance of 25.80 feet to an iron pin, North 730 02' 27" East a distance of 28.50 feet to an iron pin, and South 190 17' 33" East a distance of 97.15 feet to a steel post found at a :•—._:iL_-=_�._uJe 132 corner common to the said Williams property and lands now or formerly owned by James D. Campbell (Deed Book 644, Page 715); thence, with the west line of the Campbell property, South 190 17' 33" East a distance of 210.65 feet to a steel post; thence, with the south line of said Campbell property, North 710 02' 11" East a distance of 242.36 feet to a steel post; thence, with the east line of said Campbell property, North 190 17' 19" West a distance of 487.23 feet to an iron pin set in the south right-of-way line of U.S. Highway 60; thence, with the south right-of-way line of U.S. Highway 60, North 700 29' 49" East a distance of 1180.45 feet to a steel post set in the flow line of the Middle Fork of the Massac Creek; thence, with a line common to properties owned by Tommy Overstreet (Deed Book 641, Page 100), George Lankton (Deed Book 607, Page 794 and Deed Book 646, Page 312), and Mike J. Streetman (Deed Book 729, Page 97), South 100 38' 12" West a distance of 1711.74 feet to an iron pin set at the southwest corner of said Streetman property in the north line of the lands of the Greater Paducah Economic Development Council, said north line being the existing corporate limits of the City of Paducah; thence, with said north line and city limits, North 730 22' 18" West a distance of 177.25 feet to the point of beginning. The above described parcel of land contains 54.9037 acres, and is in all the lands conveyed to the Greater Paducah Economic Development Council by deed of record, Deed Book 782, Page 685, and is subject to a 150 foot wide easement granted in favor of Kentucky Utilities, and is subject to an unrecorded easement to Jackson Purchase Electric Cooperative Corporation. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chalyer 424.
