AN ORDINANCE PRESCRIBING TERMS AND
CONDITIONS WHEREBY LICENSED PEDDLERS MAY
USE THE CITY STREETS WITHIN THE DOWNTOWN
BUSINESS ZONE FOR DISPLAY AND SALE OF
MERCHANDISE FROM MOBILE PUSHCARTS,
HANDCARTS, OR WAGONS.
WHEREAS, it is the belief of the City that under certain
�1 -- circumstances licensed peddlers should be permitted to display and sell
merchandise from mobile pushcarts; handcarts, or wagons within the
downtown business zone; and
WHEREAS, it is the belief of the City that it is in the best
interest of all concerned to specify the terms and conditions that must be
met and adhered to by individuals seeking to be licensed to sell
merchandise in the aforesaid manner.
NOW, THEREFORE, be it ordained by the Board of
Commissioners of the City of Paducah, Kentucky, as follows:
SECTION 1. It shall be lawful to operate, display, and sell
merchandise from mobile pushcarts, handcarts, or wagons, only under the
following conditions:
(a) Each operator must first procure a city business
license and fully comply with Section 17-37 of the Code
of Ordinances.
(b) Each peddler must prepare, conspicuously post, and
maintain on his pushcart, handcart, or wagon a
permanent, printed placecard or plate, not less than 8
inches by 8 inches, which shall bear the words "Licensed
Peddler," and plainly list the owner's name, address,
telephone number and the number of his business license
and the date it expires.
(c) Motor vehicles may not be used for displaying or selling
merchandise under the terms of this ordinance.
(d) No peddler, nor any person in his behalf, shall shout,
make any cryout, blow a horn, ring a bell, or use any
sound devise, including any loud speaking radio or
sound amplifying system upon any of the streets,
alleys, parks or other public places of said city or
upon any private premises in the said city where sound
of sufficient volume is emitted or produced therefrom
to be capable of being plainly heard upon the streets,
avenues, alleys, parks, or other public places, for the
propose of attracting attention to any goods, wares or
merchandise which such licensee proposes to sell.
(e) No peddler shall have any exclusive right to any
location in the public streets, nor shall any be
permitted to maintain a stationary location, nor shall
he be permitted to operate in any congested area where

his operations might impede or inconvenience the
public. For the purpose of this ordinance, the judgment
of a police officer, exercised in good faith, shall be
deemed conclusive as to whether the area is congested or
the public impeded or inconvenienced.
(f) No peddler shall operate, display, or sell merchandise
under the terms of this ordinance except within the
boundary of the downtown business zone. Except as
defined in paragraph (g) below, the downtown business
zone shall be defined as follows:
Beginning at a point located at the centerline of
Kentucky Ave and the low water mark on the south
bank of the Ohio River, also known as the city
limit line; thence in a westerly direction along
the centerline of Kentucky Avenue 706' to the
point of intersection of the centerline of
Kentucky Avenue and 2nd Street; thence in a
southerly direction along the centerline of 2nd
Street 192.49' to the point of intersection of
the centerlines of 2nd Street and a 23.25' alley;
thence in a westerly direction along the
centerline of the aforementioned 23.25' alley
161.63' to the point of intersection of the
centerlines of the aforementioned alley and of a
23.25' alley; thence in a northerly direction
along the aforementioned 23.25' alley 14.44' to
point at the intersection of a property line
which divides lot 11 in half which is located in
Block 11 of the Old Town subdivision; thence in a
westerly direction along the aforementioned
property line 217.86' to a point of intersection
of the property line, if extended and the
centerline of 3rd Street; thence in a northerly
direction along the centerline of 3rd Street
206.13' to a point of intersection of the
centerlines of 3rd Street and Kentucky Avenue;
thence in a westerly direction along the
centerline of Kentucky Avenue 810.9' to a point
of intersection of the centerlines of Kentucky
Avenue and 5th Street; thence in a southerly
direction along the centerline of 5th Street
824.75' to a point of intersection of the
centerlines of 5th Street and Clark Street;
thence in a westerly direction along the
centerline of Clark Street 392.58' to a point of
intersection of the centerlines of Clark Street
and 6th Street; thence in a northerly direction
along the centerline of 6th Street 824.75' to a
point of intersection of the centerlines of 6th
Street and Kentucky Avenue; thence in a westerly
direction along the centerline of Kentucky Avenue
813' to a point of intersection of the
centerlines of Kentucky Avenue and 9th Street;
thence in a northerly direction along the
centerline of 9th Street 828.5' to a point of
intersection of the centerlines of 9th Street and
Jefferson Street; thence in an easterly direction
along the centerline of Jefferson Street
1,624.91' to a point of intersection of the
centerlines of Jefferson Street and 5th Street;
thence in a northerly direction along the
centerline of 5th Street 412.95' to a point of
intersection of the centerlines of 5th Street and
Monroe Street; thence in an easterly direction

northerly direction along the centerline of 2nd

centerline of 2nd Street and the north property
line of the floodwall thence in a westerly
direction along the north property line of the
floodwall 190' to a point in the north property
line of the floodwall; thence in a northwesterly
( direction continuing along the north property
line of the floodwall 338.19' to a point in the
north property line of the floodwall; thence in a
westerly direction continuing along the north
property line of the floodwall 45.82' to a point
in the north line of the floodwall; thence in a
northerly direction continuing along the north
property line of the floodwall 508.23' to a point

property line of the floodwall; thence in a
northerly direction along the north property line

intersection of the north property line of the
floodwall and the west property line of a parcel
of land now owned by the City of Paducah as
recorded in the McCracken County Clerk's office
r in Deed Book 189, page 88 and in Deed Book 189,
page 89; thence in an easterly direction along
the aforementioned west property line 70.43 to a
point on the west property line; thence in a
northeasterly direction continuing along the
aforementioned west property line 493.61 to a
point located at the Icw water mark on the south
bank of the Ohio River, also being the city limit
line;thence in an easterly direction along the
low water mark on the south bank of the Ohio
River, also being the city limit line, 4,335' to
the point of beginning.
(g) By Municipal Order the City Commission may restrict
licensed peddlers from displaying or selling
merchandise within certain portions of the defined

downtown business zone during the activities known as
"Paducah Summer Festival" and "Old Market House Days."
SECTION 2. Any person violating any provisions of this
ordinance shall be fined in a sum not to exceed $100.00 per violation per
day. Additionally, the City shall have the right to immediately cause the
abatement of any violation hereunder and the revocation of the licensee's
city business license.
SECTION 3. This Ordinance shall be given two separate
readings in accordance with law and shall become effective upon
publication of title and certified summary thereof.
