ORDINANCE NO.
AN ORDINANCE AMENDING SUB -SECTION 28-5, BANNERS
PROHIBITED ACROSS OR ALONG STREETS AND SIDEWALKS --EXCEPTIONS OF
CHAPTER 28, STREETS AND SIDEWALKS, OF THE CODE OF ORDINANCES OF
THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Sub -section 28-5 of Chapter 28,
Streets and Sidewalks of the Code of Ordinances of the City of
Paducah, Kentucky, be amended an reordained so that said Section
as amended and reordained shall hereafter read as follows:
"Section 28-5. Banners Prohibited Aross or Along
Streets and Sidewalks -- Exceptions.
(a) It shall be unlawful for any person to suspend any
banner across or along any street, sidewalk or other public way
of the city for the purpose of advertising a person's candidacy
for public office or for any other purpose.
(b) In order to promote general events of a civic and
public nature in the eentral-Business-Bistriet Downtown Business
Zone as defined in Ordinance 93-7-4971, notwithstanding the
prohibitions set for in paragraph (a) above, any person, firm,
corporation or organization in charge of events of a civic and
public nature may hang a banner far-twe-f2t-weeks across Broadway
publicizing the event, between -Sixth -and -Seventh -Streets,

' providing the subsequent guidelines are followed.
Further, any person, firm, corporation or organization
in charge of events of a civic and public nature may hang
vertically on cantilevered arms pennants/flags/banners from
utility poles,'equipped by the City for such purposes to
publicize an event, season or generally promoting the community
providing the subsequent guidelines are followed.
Banners for commercial advertisements reflecting price
or product promotion of goods or services are prohibited. Only
one banner may be hung across Broadway at any given time and pole
banners may reflect only one theme at any given time.
(1) Applications required. Applications for a permit
must be submitted to the Mayor's office 30 days
prior to the day the banners are to be installed.
Application may take the form of a letter from the
chairman or executive director of the sponsoring
organization and must contain the name of the
person, firm corporation or organization
sponsoring the event; the dates the banners are
to be installed and remain in place; and a signed
statement by the owners of the buildings giving
the applicant permission to attach the banner to
their property or a signed statement from the
Paducah Power System authorizing use of the

utility poles.
(2)
Issuance; bonds. The permits shall be issued on a
first come priority basis. Upon issuance of a
permit, a bond of one hundred dollars ($100.00)
cash must be posted by the applicant with the city
treasurer's office. It will be released when the
banner is satisfactorily removed by the applicant
at the end of the period approved by the permit.
Otherwise, a sum equal to the cost of removal will
be retained by the city as compensation.
(3)
Liability insurance. The applicant must furnish
the city public liability insurance from a company
licensed to transact business in the Commonwealth
of Kentucky, in the amount of one million dollars
($1,000,000) covering the period of time the
banner -is -above -Broadway banner(s) are suspended.
The city, the owners of the buildings the banner
is to be attached to, and/or Paducah Power System
are to be named as additional insureds.

Material and dimensional requirements. A banner
crossing Broadway must be eighteen (18) feet above
Broadway the street at its lowest point. It must
be made of heavy -weight, weather -resistant fabric,
hung by one -half-inch grass rope sewn through the
hem with all four (4) corners sewn and reinforced.
The maximum measurements for the body of the
banner are forty (40) feet long and forty-eight
(48) inches high.
A banner/pennant/flag suspended from a utility
pole must be twelve (12) feet above the street or
sidewalk at its lowest point. It must be made of
heavy -weight, weather -resistant fabric and secured
with stainless steel bonding straps and standard
mounting hardware. The maximum measurements for
the body of the banner/pennant/flag are thirty
(30) inches wide and eighty (80) inches in length.
The entire display shall not extend beyond forty
(40) inches from the utility pole.

Review by the City of Paducah. Before any banner
is suspended, the City's Director of Public Works
shall make an examination to insure the material
and dimensional requirements specified in
paragraph (4) above have been satisfied and the
mechanism used to attach the banners to a utility
pole is of sufficient strength to sustain high
winds. The Director of Public Works shall
authorize location of all banners. Further, the
City shall designate a design review committee to
approve the content and design of all banners
prior to installation.
(c) Any person violating the provisions of this
section shall be guilty of a'misdemeanor and, upon conviction
thereof, shall be punishable by a fine of not less than five
dollars ($5.00) nor more than one hundred dollars ($100.00) and
each day such offense is committed shall be deemed a separate
offense and shall be subject to a separate penalty under the
provisions of this section.
SECTION 2. This ordinance shall be read on two
separate days and will become effective upon summary publication
pursuant to KRS Chapter 424.
