ORDINANCE NO. 93-10- SD a T
AN ORDINANCE CLOSING A PORTION OF 22ND STREET AND AN
UNNAMED ALLEY LOCATED ON THE EAST SIDE OF "B" STREET
WHEREAS, Amos Wahl, Jr. and the City of Paducah, Kentucky,
have requested that a portion of the rights-of-way known as 22nd Street and
an unnamed alley located on the east side of "B" Street be closed; and
WHEREAS, the Planning Commission approved these closings on
October 4, 1993; and
WHEREAS, the Board of Commissioners finds that these rights-of-
way are unimproved and are not needed as public rights-of-way; and
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah does hereby authorize the
closing of a portion of 22nd Street and an unnamed alley located on the east
side of "B" Street which are more particularly described as follows:
Beginning at an iron pin set 30 feet east at right angles from the
centerline of "B", said centerline point is located 30 feet north with the
centerline of "B", Street from the centerline intersection of "B", Street
and 22nd Street; THENCE South 60 degrees 24 minutes 30 seconds East
for a distance of 244.59 feet with the north right-of-way of 22nd Street
to a point; THENCE South 27 degrees 35 minutes 56 seconds West for a
distance of 59.46 feet to a point located on the south right-of-way of
"B" Street; THENCE North 60 degrees 24 minutes 30 seconds West for
a distance of 244.58 feet with the south right-of-way of "B" Street to
a point located 30 feet east at right angles from the centerline of "B"
Street; THENCE North 27 degrees 34 minutes 56 seconds East for a
distance of 59.46 feet to the point of beginning. Together with and
subject to covenants, easements, and restrictions of record. Said
property contains 0.3337 acres more or less. Also including an unnamed
alley beginning at a point located 30 feet east at right angles from the
centerline of "B" Street, said centerline point is located 189.75 feet
south with the centerline of "B" Street from the centerline intersection
of "B" Street and 22nd Street; THENCE South 62 degrees 25 minutes 04
seconds East for a distance of 84.01 feet with the north side of an
unnamed alley to a point; THENCE South 26 degrees 58 minutes 32
seconds West for a distance of 23.15 feet to a point on the south side of
a unnamed alley; THENCE North 63 degrees 01 minutes 28 seconds West
for a distance of 84.26 feet to a point with the south side of an unnamed
alley to an iron pin with cap set 30 feet east at right angles from the
centerline of "B" Street; THENCE North 27 degrees 34 minutes 56
seconds East for a distance of 24.04 feet to the point of beginning.
Together with and subject to covenants, easements, and restrictions of
record. Said property contains 0.0456 acres more or less.
SECTION 2. The City is approving the closing of the right-of-
way contingent upon the adjoining property owners granting to the City a
permanent utility easement thereon, over and under the right-of-way being
closed.
SECTION 3. The Corporation Counsel of the City of Paducah,
Kentucky, is hereby authorized, empowered and directed to institute and
prosecute, pursuant to KRS 82.405, an action in McCracken Circuit Court for
a judgment ordering the closing of the streets and ally described in Section
1 above.

SECTION 4. This ordinance shall be read on two separate days
and will become effective upon summary publication pursuant to KRS Chapter
424.
